For once the Supreme Court moved swiftly

 AS PUBLIC CONCERN   continues to mount  over revelations of Deputies “donations’’ and linked contracts,  the Supreme Court will hold an extraordinary meeting on Tuesday, Mar 13  to discuss an unconstitutionality claim against the regulations regarding donations  made  from the budget of the National Assembly.

Chief Justice Jose Ayu Prado has warned that donations by deputies

are not endorsed by “any constitutional, legal or regulatory provision.”

The lawsuit against the decree was filed by attorney Ernesto Cedeño.

An investigation by La Prensa documented that from July 2014 to December 2016, the Assembly disbursed $14 million in donations that, for the most part, did not go to the intended parties.

In addition, $68 million of the budget of the Assembly has been allocated for professional services contracts, for work that has almost never been done.

The president of the National Assembly, Ruben De Leon, announced the suspension of the donations in the week ending Mar.10.

Comptroller Federico Humbert has ordered an audit of the  disbursements.

THE “DONATIONS”  handed out by lawmakers in the  National Assembly are unconstitutional says  Panama’s Supreme Court.

The ruling came on Thursday March 16 when the Court  voided a decree of the Comptroller of the Republic issued in October 2016, which regulated the delivery of donations by deputies.

“The decree is unconstitutional, because it regulates a matter that is unconstitutional,” said Judge Harry Diaz, who wrote the majority decision.

In a letter dated March 6, Diaz  had warned that the Assembly has been delivering these donations without there being “any constitutional, legal, or regulatory provision.”

The ruling came after La Prensa published a series of articles that found that many of the $14 million in  donations made between July 2014 and December 2016 never reached the intended recipients. Linked to the donations were  “contracts” totaling some $68 million.

Comptroller Federico Humbert said in a statement that he supports the ban on donations, and will seek to expand the court’s ruling.

THE GOVERNMENT’S Administration Prosecutor , Rigoberto González, has urged Panama’s institutions that make donations with public funds to “pay attention” to the decision of the Supreme Court (CSJ), which  has declared “unconstitutional” the decree issued by the Comptroller on donations handed out  by the National Assembly.

He affirmed on Friday, Mar.24, that the CSJ ruling is clear and the donations  with public funds “have no basis in the Constitution”.

Other State Bodies, such as the Executive, also give donations and support through a discretionary fund handled by the President of the Republic.

La Prensa documented that between July 2014 and March 2017, the Legislative branch managed $14 million in donations and subsidies, which in some cases did not reach their alleged beneficiaries.

Lawmaker handouts come to an end

PANAMA lawmakers are going to find it harder to reward family members and supporters or buy votes for re-election following the ban on all types of donations or subsidies by  the institution.

National Assembly, president  Yanibel Abrego, made the announcement of the prohibition on the re-opening of the legislative body On Monday, July 9.

She said that the adopted measure is in faithful compliance with the ruling issued by the Supreme Court  The prohibition includes private donations or institutions, without exception.

The court said that there is no legal rule that states that the deputies or institutions as such, includes among its functions the giving of donations or providing subsidies.

The President of the National Assembly will deliver to the Comptroller, 514 checks of donations that were lodged in the Treasury Department for their annulment.

To ensure compliance with the measure, Abrego ordered that, if there are funds contemplated in the current term, they should be destined only for purposes authorized by the Constitution.

The donations of scores millions of dollars often with no clear destination or proof that they reached intended causes, was revealed by a La Prensa investigation, which triggered the Supreme Court ruling.

Report on lawmakers’ donations under wraps

THE RULERS of the National Assembly (AN) appear to be sitting on the report of a commission that investigated irregularities in donations made by deputies.

Some lawmakers and leaders of organised civil society are demanding that a report of the internal commission that investigated irregularities detected in donations and contracts for professional services granted by the Legislative Body.

The petition arose because several MPs said they had not seen the report, even though it was delivered on April 10 to the then president of the AN, Ruben De Leon.

The internal commission, created on March 9, was chaired by. YanibelÁbrego, recently elected president of the Assembly.

The commission also included  Leandro Avila, (PRD); and Juan Carlos Arango, of the Popular Party (PP).

It commission was formed based on an investigation by La Prensa, which revealed that

From July 2014 to March 3, 2017, the Assembly disbursed $14 million in subsidies and donations of the deputies, which in most cases did not reach the original beneficiaries, usually people with low economic resources or  living in marginalized areas of the country.

La Prensa also documented that between July 2014 and December 31, 2016 the Assembly allocated $68 million to pay for professional services contracts, which in most cases were not carried out.

The Comptroller General of prdered an audit of donations and contracts of the AN, which has not been delivered.

The independent deputy, Ana Matilde Gómez, was the first to request the report from the Assembly President on July 11, one day

After Ábrego announced that that the AN  accepted the ruling of the Supreme Court of March 16, , which declared unconstitutional the decree of the Comptroller that regulated the donations of the AN.

On that day, Ábrego forbade deputies to make more donations.

Gómez praised the announcement of Ábrego, but at the same time asked for the report that, in her opinion, had to be presented by De León before leaving the AN presidency since “everyone who leaves a position must render accountability.”

La Prensa says it called De León to know why he did not reveal the report, but he did not answer. Since his departure from the presidency of the AN on July 1, he has rarely been seen in the chamber.

Senior Lawmaker claims “ignorance” of the law

DEPUTIES who had their names printed as “donors” on state vehicles operating in their constituencies are moving to have them removed with one Assembly vice-president claiming ignorance of the law and others claiming a witch hunt.

Democratic Change (CD) lawmaker and vice-president of the National Assembly, Raúl Hernandez,  said he did not know about the legal prohibitions that prevent his name being used on state property.

“I will send my team to remove the the signs on vehicles of communal boards and schools, ” he told La Prensa which uncovered the scandal

The Civil Code clearly stipulates that “ignorance” of the law “ is no excuse ” for offenders

Hernández said that he had his name added after the delivery of the vehicles, contrary to what was said by the Mayor of La Pintada, Ina Rodríguez, who said that she received equipment carrying the name of his aunt, CD Deputy Dana Castañeda.

The name of  Raúl Hernández is prominent on state vehicles in El Valle de Anton reports a Prensa.

Assembly corruption probe stymied

PANAMA’S National Assembly has effectively shut down a corruption investigation of its officials by failing to provide information required by Anti-Corruption Prosecutors.

The  Public Ministry Anti-Corruption Prosecutor’s Office has asked the Judicial Body to file the investigation of  Assembly officials for the supposed misuse of scores of thousands of dollars  allocated to grants and contracts for professional services.

Sources at  the Public Ministry confirmed to La Prensa that the request of prosecutor Javier Miter Burgos is based on the lack of key information for the surveys.

Miter requested information lin  July from the National Assembly on the contracts of personnel for professional services and donations, but it has not been delivered , which is why he was forced to request the provisional dismissal of the process.

The investigation began on the basis of a complaint filed on April 20 by the Foundation for the Development of Citizen’s Freedom, a Panamanian chapter of  Transparency International, against five officials of the National Assembly and one of the Municipality of Veraguas, accused of the alleged commission of crimes against public administration.

The officials identified in the complaint were named in an investigation published by La Prensa during the week of March 6 to 11, related to donations that in the majority of the cases were not received by the beneficiaries, and contracts for professional services that were not provided.

The irregularities would have occurred during the last two legislative periods, 2015-2016 and 2016-2017, both presided over by PRD  deputy  Rubén De León.

Among those reported are the coordinator of the donation process and advisor to the Presidency of the Assembly, Teófilo Gálvez; and the secretary of the president, Isabel Araúz.

Also denounced   are: Ismael Frías, assigned to the office of CD  deputy Juan Poveda, (who allegedly managed temporary contracts for his nephew for almost $10,000 and checks for thousands of dollars to cover alleged donations for home expenditures) and Marisela Araúz, assigned to the audit office of the Comptroller

in the Assembly .and Raúl Moreno, from the  Assembly Technical Secretariat for Social Affairs  who approved professional services for thousands of dollars to third parties who many times they did not provide services.

Finally,  reports La Prensa, the complaint points to Luis Cruz, Secretary General of the Municipality of Santiago (Veraguas), who received $20,000 in donations to allegedly support the Santiago Apostle celebration , and another $ 2,400 for a trip to China.

He was denounced for allegedly using “public money for purposes other than their functions”.

Meanwhile, the Supreme Court rejected a habeas data request from lawyer Ernesto Cedeño, in which he asked the Comptroller’s Office for information on the amount paid by the State in the form of grants authorized by the National Assembly.

However, the Comptroller’s Office denied the delivery of the information to Cedeño ast the entity competent to resolve the petition is the Assembly, since the Comptroller’s Office does not have  the original documents of the endorsements and cannot deliver authenticated copies

With the presentation of the magistrate Luis Ramón Fábrega, the plenary resolved the habeas data on August 29 and concluded that it cannot compel an entity to deliver information that it does not have.

THE CITIZEN watchdog organization “Together We decide” has called on the Comptroller General of Panama for a progress report on the work of a team of auditors installed in the National Assembly to investigate donations, subsidies and professional services contracts. issued by lawmakers.

“It has been more than eight months since the group moved in and we still do not know progress or conclusions of its work, ” said a letter delivered to the Controleria.

According to the organization, Humbert must inform the country about the findings that have been made in the more than eight months it takes the work of the officials.

“We Panamanians have not forgotten this corruption scandal.” the group said in its note to Humbert.

“The fact that the Comptroller’s Office does not inform citizens in a timely way contributes to the growing lack of trust in public institutions and makes them seem accomplices.”

Transparency  International (TI) is on the tail of Panama’s Comptroller General, Federico Humbert to discover what has happened to an audit that began in the National Assembly eight month ago.

Lina Vega Abad, President of – the Foundation for the Development of Citizen Freedom, the Panama chapter of TI has sent a letter to the Comptroller  reminding him that investigations by The Public Prosecutor’s Office of donations and subsidies, were dismissed “due to the absence of the corresponding audits of the Comptroller General that, obviously, are the fundamental pieces of the process “.

Last April, an investigation by La Prensa documented that The Assembly distributed $14 million in donations that, mostly did not end up with the original beneficiary, as well as $68 million in contracts for professional services for jobs that almost never took place.

The monies were distributed between July 2014 and March 3, 2017, during the presidencies of the deputies Adolfo Valderrama (2014-2015) and Rubén De León (2015-2017).

“The fight against corruption and the abuse of power requires the commitment of all; from the State institutions and the organizations of civil society. We all have a role to play to preserve democracy and institutions, “writes Vega Abad in her note to Humbert.

On April 20, 2017, the Foundation filed a criminal complaint with the Public Prosecutor, against five officers of the Assembly and one of the Office of the Comptroller General for the alleged commission of the crime of embezzlement.

In September, the Second Anti-Corruption Prosecutor’s Office requested a provisional dismissal, because of the lack of corresponding audits.

The complete publication of the payrolls and donations of the National Assembly, together with the scandal of Pandeportes funds that were laundered by corrupt federations and organizations, to benefit deputies, reminds us of the repugnant face of clientelism.

In the name of meeting the infinite needs of voters, politicians take advantage of the campaign to deliver goods or money in exchange for votes. Once elected, voracious electoral machinery needs new funds to stay active. That gift of public money, that is to say, of the taxes that we all pay, cause the shortage of medicines, the bad educational situation of the country, the cost overruns of public works and even the unnecessary hiring.

The cynicism and corruption practiced by the voters are the counterparts to the great corruption that prevails in a large part of Panamanian politics. "What's there for me?" Seems to be the reasoning that makes up an important part of the population. That mentality has turned the State into a bazaar and democracy into a business for the highest bidder – LA PRENSA Apl. 30.

Panama’s Appeals  Court of Appeals on Wednesday, August 7 denied  the habeas corpus action filed by the defense of former National Assembly president  Rubén De León, under  investigation for corruption involving Assembly expense funds while he served as a deputy

The habeas corpus was presented by the lawyer Ángel Alvárez, who claimed that there was

"danger of personal freedom of De León". The Court gave each of the parties 15 minutes for their arguments.

Prosecutor Adecio Mojica said that no charges have been laid against  De León, nor has his arrest been ordered, so there can be no threats to his person.

De León did not appear on August 6 at an indictment hearing for the alleged commission of crimes against the public administration in the case of the forms of the Assembly.

A judge of guarantees indicated that the lawyer of De León [Roberto Moreno] had the obligation that the former deputy was at the hearing.

The defense also argued that he cannot be judged in the ordinary courts and that he must be in the Supreme Court because he is a deputy of the Central American Parliament (Parlacen).

The prosecution maintains that De León has not yet been sworn in the Parlacen.

The unveiling by Panama’s Comptroller of multi-millions of dollars misused by members of Panama’s legislature was described as “peanuts”   by "Tito" Rodríguez vice- president of the National Assembly.

Rodrigues, alleged to have dispersed over $7 million dollars of taxpayer-funded expense rolls said that they are small things compared to what will be discovered when the comptroller Federico Humbert attends the legislative plenary, where he hopes he will be held accountable for discrediting the Assembly.

“That worksheets are peanuts , they are very small things. You know how journalists and  the Comptroller have  tried to discredit the National Assembly. We as Assembly officials have to give an explanation to the nation. How good it would be for him to come and answer  the 20 questions we are going to ask him, ”Rodríguez said.

Rodriguez said the plenary is scheduled to quote Humbert and that a questionnaire of 20 questions is already being prepared.

 We have seen in less than a month a really pathetic, sad, shameful Assembly, which has helped sink our country and our institutionalism into a deep distrust, ”said Horacio Icaza, of the Independent Movement (Movin).

The Comptroller is a subject that interests the deputies. The call for candidates to submit their resumes had not started, and the PRD bench, which is a majority in the Assembly, had already chosen its candidate.

"I think it is a public and notorious fact that the bench met about two days ago and they made the

decision to run Gerardo Solís," for the position of comptroller. "How is it possible that not even the resumes and all the benches have been received, with the exception of the independent bank, they are talking about the anointed one, who will be the comtroller," Icaza added.

The process to name the next comptroller is running at full throttle. Applications closed on Friday and next Monday the Credentials Committee meets to examine the 57 submitted. resumes

They are neither mouthpieces nor toilet paper, as one PRD deputy says, furious because the media have investigated the use of money that some deputies and/or the National Assembly give to state money. These are serious irregularities in the expenditure of $113 million in contracts for about 15,000 people and $ 15million in donations for 6,000. And there he found everything, according to an audit of the Comptroller. This would explain why some conspicuous deputies have led their artful attacks against the Comptroller, the Public Ministry, and the media. First Superior Court of Justice  has admitted an  appeal filed by the Special Anti-Corruption Prosecutor's Office on the ruling that determined that the Public Prosecutor's Office cannot investigate the former president  of the National Assembly Rubén De León, and elected deputy of the Central American Parliament (Parlacen) - for alleged anomalies in Assembly  expense  forms 

The superior court says that it granted, the appeal filed by anti-corruption prosecutor Zuleyka Moore, and referred the process to the Supreme Court.

This evolution effect implies that the decision being appealed is not paralyzed until such appeal is resolved, said  Roberto Moreno, a lawyer of  De León.  

 The ruling of the First Court, of August 9 and with a presentation by Judge Olga Rujano, received an appeal presented by the lawyers of De León against the decision of the judge of guarantees Clara Montenegro to conduct a hearing of imputation and application of measures precautionary to De León by the process of the returns.  

Prosecutor Moore had described the ruling as "unfortunate" and totally different from what the Supreme Court has said on this matter.  

Moore recalled that the Supreme Court has argued that it is one thing to be an elected representative of the Parlacen and another is the prerogatives to which the members of that forum are entitled once sworn, so she appealed the ruling.  

This Thursday, August 29, Panamanian deputies in the Parlacen - among them De León - will be sworn in by the directive of this regional body. De León was elected by the Democratic Revolutionary Party.

Panamanian deputies of the Parlacen will be sworn in Nicaragua on Thursday, August 29.

The investigation in the case of De León is related to alleged anomalies in the collection of checks linked to the returns of the Assembly.
