    NOTHING seems to shake the determination of the scandal-plagued  Odebrecht construction giant to add to the nearly $3 billion in contracts from the Panama State and Panama city.

    In spite of warnings that the Executive approved an order in December 2016 prohibiting the company from bidding for State contracts it has already attended four approval meetings, reports La Prensa.

    The company, which has recognized the payment of bribes to win contracts in multiple countries, including Panama,  was among the 11 construction companies that attended to the approval meeting of the Ministry of Works Public to clarify the specifications of the tender to rehabilitate 80.3 kilometers of highway in Chiriquí, with a reference price f $49 million.

    Panama signs tax avoidance  convention

    PANAMA and high-level officials from Barbados, Côte d’Ivoire, Jamaica, Malaysia, and Tunisia have signed an OECD  Multilateral Convention to reduce opportunities for tax avoidance by multinational enterprises.

    The Convention is the first multilateral treaty of its kind, allowing jurisdictions to integrate results from the OECD/G20 BEPS Project into their existing networks of bilateral tax treaties. “Today’s signing of the multilateral convention is another major step towards updating the international tax rules through the swift implementation of the BEPS package,” said OECD Secretary-General Angel Gurría. “Beyond saving signatories from the burden of re-negotiating thousands of  tax treaties bilaterally, the convention results in more certainty and predictability for businesses, and a better functioning international tax system for the benefit of our citizens.”

    A HIGH alert for operators of yachts, tourist boats and fishermen on the Caribbean coast has been issued by The Panama Maritime Authority (AMP).

    The warning, issued on Friday, Jan 26 extends until Sunday, January 28. It predicts  strong and high waves,  a rise in the sea level, increased currents, a reduction in beach areas and storms on a recurring basis

    Seacraft operators should take  “extreme cautionary measures to guarantee safe navigation,” says the AMP  message.

    Two young girls hit in shootout

    TWO YOUNG  girls are in hospital, one in “delicate” condition after being hit by bullets in a shootout in San Miguelito on Thursday, January 25.

    The girls, aged 5 and 9 years old, were  exposed to a hail of bullets in what is believed to be a gang-related incident the Nuevo Progreso sector of Nueva Libia,

    One of the girls is in delicate condition and the other is under medical observation the Hospital   Del Niño  (Children’s’ Hospital) one was hit in the chest and the other received a bullet in the chin.

    The National Police launched a major operation following the shooting reports El Siglo.

    THE RATIFICATION   by Panama’s National Assembly of two women nominees as Supreme  Court judges would be a great step for the Court “and for equality between men and women in our country.” said  Vice President Isabel de Saint Malo on her Twitter account.

    Saint Malo also noted that “9 countries in Latin America have judicial bodies whose composition of women is 30% or more.”

    On Wednesday,  January 24, after a series of bruising meetings when the nominees sat through denunciations of their suitability followed by harrowing, often unrelated, questioning by some deputies,  the Credentials Commission narrowly approved the ratification of the appointment of Judges Zuleyka Moore and Ana Lucrecia Tovar.

    The lawyers received the support of the ruling party. Four of the five votes in favor were issued by the Panameñistas Luis Eduardo Quirós, Adolfo Valderrama, Jorge Iván Arrocha and Jorge Alberto Rosas. While the additional vote was José Muñoz, Cambio Democrático (CD) and founder of his own party (Alianza).

    The approval of Moore and Tovar,) to replace Jerónimo Mejía in the Criminal Chamber and Oydén Ortega in the Civil Chamber of the Supreme Court will be debated in a National Assembly plenary where they can expect more verbal sticks, stones and arrows.

    A 48-year-old taxi driver whose car ended up embedded in the back of a transport truck on Thursday night. Jan.25,   became the 24th highway fatality of 2018, and the second taxi operator to die in a crash during the week.

    The latest accident was on the Pan-American Highway in the Union de Azuero community in the Chepo district. The earlier incident was in Veraguas, and the driver was killed in a head-on collision

    Juan Carlos Navarro, the PRD presidential hopeful in the 2014 presidential campaign, received a $20,000 donation from the Blue Apple company that is now the center of a major corruption investigation.

    This was stated in the sworn statement of contributions delivered to the Electoral Tribunal (TE), by Navarro, in July 2014 and ratified by his spokesman Max Bedoya, reports La Prensa.

    The legal representative of Blue Apple was the lawyer Federico Barrios, who is in preventive detention as part of the investigation of the case by the Sixth Anti-Corruption Prosecutor’s Office.

    Prosecutors are following the trail of alleged payment of bribes and other acts of corruption by contractors of the Panamanian State who belonged to the Blue Apple bribery structure created to pay off government officials.

    On February 21 of last year, the PRD published in its Twitter network the list of people who contributed to the campaign, in the midst of the national debate over the investigation by the Public Ministry, after the Brazilian construction company Odebrecht admitted having bribed Panamanian officials, Navarro explained

    Another of the donors to the PRD campaign who appears on the list is Joaquín Rodríguez Salcedo, also in detention over the Blue Apple case. He donated $5,000.

    Rodriguez Salcedo, former vice president of Factoring and Surety of Global Bank, has been charged with alleged  money laundering and other offenses

    Navarro’s spokesman, Bedoya, confirmed that the campaign of the PRD received, on March 20, 2012, a check from Blue Apple Services.

    “At the moment of receiving the contribution, we proceeded to issue a donation receipt to the aforementioned company, as was done with all donations received by the campaign. A copy of the check and the respective donation receipt was also sent to the Electoral Tribunal ” said Bedoya.

    Panama: NO to Companies Condemned in Other Countries

    A new law initiative pretends to forbid the participation of companies that have been convicted in other countries for crimes against the public administration in contracts with the State.

    The bill that was presented on January 23, requests the modification of texts in the legal framework that regulate Panamanian public procurement, to avoid awarding contracts to companies that are accused of acts of corruption in Panama and also abroad. 

    From the introduction of the bill:
    " ... we deem it opportune to propose the inclusion of grounds for the legal incapacity to contract, through an addition of numeral 9 to article 16 of Law 61 of 2017, since although there was a recent reform, [the text] only included as a cause of inability to contract the existence of a judicial sentence of conviction within the national territory."

    " ... the proposal is to introduce, through the addition of numeral 10, the obligation of the contractor to make an affidavit stating that they have not been convicted of crimes against the public administration within the territory of the Republic of Panama or abroad."

    WEDNESDAY’S session of the Assembly Credentials Committee should have served for an enlightened exchange between the deputies and the magistrates appointed to the Supreme Court of Justice. Instead, some deputies gave a show  a childish arrogance. At times, the session seemed like a theater of horror, directed to humiliate the candidates and their substitutes. The insistence on trivial questions and veiled threats confirmed the perception that the best interests of the deputies were not to promote a sound administration of justice, but rather to corner the jurists. They spoke of both ethical faults and conflicts of interest and seemed to forget that they themselves are a true reflection of these problems.

    After the circus show of yesterday, it is becoming more and more evident where they are able to arrive in order to exhibit a power that they themselves usurp with their questions of illegitimacy while they are questioned by their lack of probity in the exercise of their functions as deputies. It goes now to the full decision [in the Assembly] hopefully in a serious debate – while the Panamanian justice system is still immersed in the biggest crisis in our history… LA PRENSA- Jan. 15.

    Energía Verde, S.A. submitted an EIA to build in the district of Gualaca, province of Chiriqui, a wind farm that will have 11 wind turbines, each with a nominal power of 1.8MW. According to the study, the project called "Parque Eólico Chimenea" will involve an investment of approximately $45 million.

    Progreso Solar 20MW, S.A. submitted an EIA to build, in the province of Chiriqui, a photovoltaic power plant, consisting of 66,596 crystalline modules 300-72P.     AN INVESTIGATION has been opened   by the Anticorruption Prosecutor’s Office of the Attorney General to determine criminal liability over the removal of files from a judge’s office  related to the Financial Pacific investigation,  which involves many key members of the Ricardo Martinelli Inner Circle

    The Attorney General has requested an imputation hearing and application of precautionary measures, over the finding of six files relating to the case on a public highway.

    The investigation being carried out is related to the possible commission of the crime against the Public Administration and  is intended to determine the criminal liability for the alleged removal of documents that should have been in custody in the judicial office.

    Ricardo Martinelli could be back in Panama no later than April, according to lawyer Sidney Sitton, who is part of the defense team of the ex-president.

    The latest statement in the flip-flop farce came on Thursday, January 25, the day after Martinelli spokesman, Luis Eduardo Camacho had said that the former CD leader would be appealing the Jan. 22 decision of a judge,  confirming his extradition.

    Sitton said on AM News that after the Tuesday hearing the defense team talked with their client and explained that the case for which he is being processed [wiretaps] was  “easy to face in Panama” because it is flawed.

    If the bail is granted Martinelli’s defense, would not change his decision to return to Panama, according to what was agreed at the two-hour meeting held on Tuesday January 22, when the hearing concluded.

    Sitton said that if the judge decides to grant bail, she should pass it to the Department of State to do the political-administrative process for the extradition, but it would be done under freedom.

    Once Martinelli arrives in Panama, he goes before a judge in the Supreme Court of Justice, later he would resign from the Central American Parliament (Parlacen) and will go to the ordinary courts and the case would be treated under the Accusatory Penal System (SPA), said Sitton

    Government authorities reported that the country has been removed from the list of countries considered non-cooperating in tax matters, after it was included in December 2017.

    In a statement published by the Ministry of Foreign Affairs of Panama, it is stated that " ... the Council of Economic and Financial Affairs of the European Union, known as ECOFIN, decided to exclude Panama from the list of non-cooperative countries in tax matters, in which our country was included on December 5, 2017."

    Authorities highlight that " ...Panama has been executing a road map, approved within the framework of the High Level Commission for International Financial Services (CANSIF), in which the private sector participates, and whose objective is to ensure the country's competitiveness and compliance with the highest global standards in fiscal and financial matters."

    Although we expect  growth of the Panamanian economy of approximately 5.4% for this year 2018, such increase continues to be supported by economic sectors linked to foreign trade, such as the Panama Canal, ports and airports.

    As a representative organization of the country's private entrepreneurial effort, the Chamber of Commerce, Industries and Agriculture of Panama (CCIAP) reiterates its concern about the problems that hamper the progress of sectors long marginalized by policies that discourage their permanence and certainly threaten their productive continuity, such as the industrial and agricultural sectors. The same is true for other slowdowns such as trade, tourism, construction and real estate, which also require new perspectives in the future.

    Not only were fewer companies were created in 2017, but more companies were closed than in 2016.

    Although growth of the economy in general still remains above 5% -still far from the vigorous 10% of a few years ago- other macro data, such as the increase in unemployment and the growth of independent or informal work, shows that, starting in 2018, Panama has entered a phase of economic slowdown. Businessmen in the commerce sector are even talking about "recession", both in retail and in wholesale sales.The Chamber of Commerce, Industries and Agriculture of Panama (CCIAP) reiterated "its concern about the problems that are hampering the progress of sectors long marginalized by policies that discourage their permanence and certainly threaten their productive continuity, such as industry and agriculture.     An article on Prensa.com reports that "For the economist Rolando Gordón the increase in unemployment is closely linked to the number of notices of cancellation of operations last year. He indicated that higher costs in electricity bills, as well as in other inputs could have had an impact on the closure of these companies."

    SCORES   of Panama citizens used their lunch hour on Tuesday, January 23 to continue the “enough is enough” protest against corruption and impunity that began on the Cinta Costera on Jan 9.

    By coincidence, the demonstration began shortly before ex-president    Ricardo Martinelli appeared in court  in Miami  to hear  a US Federal judge endorse an earlier decision that he should be deported  to Panama to face trial,

    Martinelli, is  widely believed to have been   the leader and biggest  benefactor  of a “den of thieves” who pillaged the nation’s treasury, and whom he described on CNN as a “cabinet of businessmen”

    protest-1-300x169.jpgThe protesters assembled  outside the offices of Attorney General Kenia Porcell and while their numbers  fell far short of the 10,000 who gathered on the Coastal Strip two weeks earlier  they  made up for the shortfall with drums, tambourines and creativity in the production of banners carrying their message,

    The announced purpose of the latest public outcry was to get Porcell to release the names of over 50 members of the previous administration -and potentially some in the present-  who are under investigation for accepting bribes from the Odebrecht construction company that received billions of State dollars.

    Among the protesters were representatives of various sectors of organized civil society, who vociferously repudiated corruption cases that have shaken the country and drained state coffers.

    Guillermo Marquez Amado, a former magistrate of the Electoral Tribunal, said that the latest gathering was to keep the memory alive among the citizenship that the Attorney General’s office is in default with its promise to disclose “the list of members of society that have committed acts of delinquency…

    “Panamanians need to know who, among us, hurt us,” he said.

    “The other issue is the financing that could have been given to political parties and candidates in the last campaign and that should also be a matter of public knowledge, “he said.

    Allegations have surfaced that the Democratic Change presidential candidate. Domingo Arias, and then-candidate Juan Carlos Varela received campaign funding from Odebrecht.

    Estrella de Calvo, a 78-year-old  said “We are tired of “corruption” and

    the country does not want more “companies handing out bribes or corrupt politicians. Enough is enough.”

    He is sovereign and we have decided to put an end to this, “the retired woman added.

    Rafael Zevallos, one of the organizers, said the issue of corruption is very complex and is not limited to a list. He said that another issue for which they ask for pronouncements is that they no longer prosecute all corruption cases; the cases should be resolved in the courts but there should be jail sentences.

    Others  complained about cosy deals in which the wealthy corrupt were able to avoid prison by  paying money  from the loot they had stolen.”

    Supreme Court Judge Ángela Russo, on Wednesday, January 24 presided over The reconstruction of the traffic accident involving a CD deputy that left 14-year old schoolgirl f Ruth Parreño dead in Colon in December.

    Deputy Mario Lázarus- in the company of his lawyer, declared his innocence and said that the facts will be clarified.

    He also asked for forgiveness from the Parreño family for the unfortunate accident. [He was reported to have left the scene of the accident]

    Judge Russo is acting  as a prosecutor, as the deputy’s case has to be tried by the Supreme Court

    Victor Parreño, the father of the dead girl, demanded that justice be done because “Lázarus must pay for taking my daughter away”.

    JUST 24 HOURS  after the  lead lawyer for former Panama President Ricardo Martinelli announced that his client would be making no more appeals  against extradition and would return to Panama to face justice his former government PR  flack  said that Martinelli will ask for bail and will appeal Tuesday’s ruling by US Judge Marcia G. Cooke, confirming  his extradition.

    The flip-flop announcement comes from  Luis Eduardo Camacho. in a statement made in Miami to Efe News Agency following a meeting with Martinelli in the Miami detention center where he has been held since June 12.

    Camacho said on Wednesday that at this point in the process it would not make sense to ask for bail if there was no intention to continue fighting extradition.

    “Those who expected that Martinelli was down, were wrong. Today I found him  with a lot of enthusiasm, evaluating scenarios and making decisions.” Camacho said.

    Although  judge gave thumbs down to an appeal filed by Martinelli’s defense against the decision of Judge Edwin Torres, who in  August gave the green light to the extradition, Cooke indicated that she was willing to consider a new request for bail for the ex-ruler.

    According to Camacho, Martinelli, who is required to respond in Panama to crimes related to illegal wiretapping during his Presidency “will use the door opened” by Cooke.

    The judge gave the defense until February 6   to decide whether or not to appeal her ruling.

    Camacho said: “In life success or failure is not a matter of luck but of identifying opportunities and taking advantage of them, ” in a statement very different from the one made Tuesday by lawyer Sydney Sitton.

    After the court hearing, Sitton told Efe in Miami that Martinelli had decided not to appeal anymore, and voluntarily return to Panama regardless of what Judge Cooke decided.

    The same day Camacho replied that Martinelli had not made a decision, but he analyzed several “scenarios” with lawyers and collaborators.

    Referring to Wednesday’s meeting in jail, said that  the former president’s  mood reflected his favorite saying:”Always be willing to fight one more round.”

    Martinelli is wanted for embezzlement and illegal eavesdropping.

    Currently in Panama is another case against Martinelli, this for the alleged irregular granting of more than 300 pardons, which may lead to another request for extradition, although it has been appealed by his lawyers.

    MEXICO January 22, – Eighteen months after the expansion of the Panama Canal began to operate, its performance exceeded expectations. According to a new Moody’s Investors Service report, the total tonnage of the channel increased 22% in fiscal year 2017 (from October 2016 to September 2017), as its capacity more than doubled, with a clear positive credit impact.

    The performance of the Panama Canal Authority (ACP, A2 stable) exceeded the projections, with an increase of 15% of revenues in fiscal year 2017, which resulted in financial indicators stronger than expected. “Solid performance will have a domino effect on US ports and cargo ships, and international trade will further benefit the channel,” says Adrián Garza, Vice President and Senior Analyst at Moody’s.

    The ACP expects revenues to exceed $ 3 billion for fiscal year 2018. Thanks to its strong performance, the ACP registers better-than-expected financial indicators, which supports its high credit quality.

    The tonnage of cargo that crossed the channel reached a record of 402.8 million CP / SUAB (volume measurement of the Universal System of Ship Arcing of the Panama Canal) in fiscal year 2017, the largest annual tonnage in history and 22% higher than the previous year. This increase is also significant given that the tonnage of the ACP was relatively stable over the last 10 years, with a compound annual growth rate of 1%.

    The channel also benefits from growth in certain business segments thanks to the new locks. Liquefied petroleum gas (LPG) grew 147% and represented 7% of the total tonnage in fiscal year 2017 compared to 4% in 2016. LPG accounted for 4% of total tonnage, compared to 0.5% the previous year.

    Challenges
    For Moody’s, although there are still challenges, including the legal dispute related to the expansion, the ACP’s solid financial position partially compensates for these challenges.

    The Ministers of Economy and Finance of the EU (Ecofin) eliminated  Panama from the list along with seven  7 other jurisdictions: South Korea, United Arab Emirates, Barbados, Grenada, Macau, Mongolia and Tunisia.

    The Economy Ministers of the 28 countries of the European Union reported  that the declassification is “justified” by an “analysis of experts on the commitments assumed by these jurisdictions to address the deficiencies identified by the EU “.

    They have underlined as the main motive the commitments acquired at “high political level” o solve the doubts of the community block.

    Panama delivered a letter a few weeks ago with these promises to the EU, whose content has not been released .

    “Our process for making the list is already proving worthwhile.”  said Bulgarian Finance Minister Vladislav Goranov,  who currently  holds the presidency of Ecofin. “Jurisdictions around the world have worked hard to make commitments to reform their fiscal policies. Our objective is  to promote good global governance.”

    Martinelli  loses extradition battle

    Ex-president Ricardo Martinelli lost his final battle to avoid extradition to Panama, on Tuesday, Jan.23 when Judge Marcia Cooke, of the Court of the Southern District of Florida, endorsed the ruling of a previous judge.

    He will return to face trial of illegal wiretapping of opposition politicians, critics, journalists and businessmen. He ia slo under investigation  in multiple corruption cases

    He remains behind bars in Miami until Feb 6, when the judge will evaluate the granting of bail while the extradition process is underway. So far he has spent 225  days  in the Miami detention center

    The prosecution has already announced that it opposes his release.

    Sidney Sitton, attorney for Martinelli, said that his client will not appeal Judge Cooke’s decision reports La Prensa.

    “I told him that when this ruling is over, we are not going to appeal anymore, we are going to Panama, win or lose”, Said Sitton.

    According to the lawyer, the decision is not motivated by  Martinelli’s  humiliating defeat in the internal elections of Cambio Democrático, in which Martinelli lost the presidency of the party that he founded 20 years ago.

    Martinelli appeared at the hearing in prison garb and with leg shackles. There were no family members in the courtroom.
