    Investigations into what was happening at the Financial Pacific brokerage are plagued with irregularities, mysteries and absurdities.

    It is very difficult to follow the track of this judicial circus, that between postponements and delaying tactics is approaching a worrying turning point. Now it is known that part of the original files were extracted from the court that had to guard them. Who knows for what purpose.

    A simple accident on a highway has revealed the scope of the rottenness and the complicity of justice.  If a case of such high profile as Financial Pacific is handled with such insouciance it is unthinkable what can be happening with others. It is evident that the Supreme Court needs a makeover.  You cannot expect that from the rotten justice tree healthy fruits will appear.

    The result of what happened on this occasion will be the change of judge, the replacement of the file and an audit of what happened.  That is, months of delay, more questions, new doubts and, in

    half of it, a single certainty: Financial Pacific will remain a scar on the conscience of the Judicial Body …LA PRENSA  Jan. 18.

    On the eve  of internal elections in the deeply divided Democratic Change party Giselle Burillo  a  former minister in the Ricardo  Martinelli administration has denounced a “false” letter from former President requesting support for Alma Cortés”

    According to Burillo, who aspires to become the secretary general of the party, the graphologist Armando Gaitán reviewed the letter allegedly written by Martinelli and compared it with other documents penned by the ex-ruler and said it is not legitimate.

    The former minister added that lawyers Luis Eduardo Camacho,  and Alma Cortés are trying to manipulate the vote to the shame of the members of the CD collective since Martinelli is being held in a jail in Miami.

    On Sunday, January 21, delegates will gather to elect the  Board of Directors with numerous candidates facing criminal corruption charges, including Martinelli’s sons who are wanted by Interpol, and the ex-president who has been in a Miami Detention Center for over seven months and is awaiting extradition to Panama.

    Black List: Panama Tax Pledges To Be Revealed

    The European Commission (EC) has called on the States of the European Union to reveal the commitments that countries such as Panama have made to escape being listed as tax havens, although they do not meet the requirements in the fight against tax evasion.

    “I ask all Member States to publish the letters of commitments they have received, said Pierre Moscovici the European Commissioner for Economic Affairs said at a Thursday, Jan.18  press conference.

    The community leader urged the Ministers of Economy and Finance of the Twenty-eight countries  to make the decision in the council to be held next Tuesday, which is expected to approve the take out of Panama, South Korea, United Arab Emirates, Barbados, Granada, Macao, Mongolia and Tunisia from its blacklist of tax havens barely a month after approving it.

    The jurisdictions have submitted commitments to amend their tax regimes, which will allow them to move to a “gray list” in which there are already 47 others that do not meet the Community requirements on fair taxation, erosion of the tax base or transfer of benefits from a territory to another but promised to take action.

    Moscovici said that the commitments presented by the eight countries are “welcome” because they show that the blacklist has made some of the countries ” quickly realize that they are interested in cooperating with the EU.”

    The 28 EC countries will evaluate by the end of 2018 if the territories that have made commitments comply with them.

    OVER 2,000 National Police uncovered firearms, knives, drugs and liquor during a search of the Nueva Esperanza prison in the province of Colón on Wednesday, January !7.

    They  also found homemade metal instruments, cigarettes, cell phones, scissors and cash.

    Alonso Vega Pino, deputy director of the National Police, said that the search was part of operations carried out every year to remove items s that could cause injury to the inmates.

    Girl 9 and grandmother killed by CSS truck

    A 9-year-old  girl and her 64-year-old grandmother were hit and killed by a Social Security Fund (CSS) truck on the InterAmerican highway, near the bridge over the Lajas River, in San José de San Carlos, in Panama West on Tuesday, afternoon January 16.

    They were just 100 meters from the family “super” and residence at the entrance of Punta Barco. They died instantly and  the collision threw both into a ditch

    Witnesses said the truck was speeding in an area where signs call for a reduction to 60 kilometers an hour. Residents say the sign is largely ignored by passing traffic.

    PANAMA’S Attorney General is drafting a law for presentation to the National Assembly that will allow the publishing of the names of those charged for corruption and unjustified enrichment to the detriment of the State and for an increase in sentences for those found guilty.

    Kenia Porcell made the announcement at a  press conference  on Monday, January  15 saying that to  remove the veil of the reservation of the summary (names of the  involved), so that there is “publicity”  will be a step forward  in transparency, following  the criticism received by the Public Ministry (MP) for concealing information in these types of cases.

    She also argued that currently, the penalty for embezzlement of the state is two to four years, while for the crime of livestock theft it is from six to eight years.

    PANAMA’S Chamber of Commerce, Industries and Agriculture (Cciap) and the Panamanian Chamber of Construction (Capac)  have instructed their ethics committees to decide on  possible sanctions that may be applied to the member companies of involved in the Blue Apple investigation  of  bribes paid by contractors of the State in exchange for the streamlining of administrative procedures for the execution of the work and the disbursement of money.

    The Capac says that it has no interference in commercial activities of its members, but to regulate relationships between companies, and the State and civil society, it approved a code of conduct.

    PANAMA got a public reprimand from the United Nations (UN) in Geneva, Switzerland for its failure to act on the rights of the child, for corruption diverting funds and sloppiness in imposing the issue on the public agenda.

    The comments came from Jorge Cardona Llorens the Rapporteur of the  UN Committee on the Rights of the Child during the review of the legal and budgetary regulation of Panama and its adaptation to the Convention on the Rights of the Child.

    The Panama,  delegation led by Yazmín Cárdenas Quintero,  Director of the Panama  Secretariat for Childhood, Adolescence and Family (Senniaf), delivered two outdated reports addressing the country’s progress. This type of survey is usually presented every two or three years, but there has been none from  Panama since 2008. The documents delivered assessed the progress in the implementation of the Child Rights  Convention in the last 10 years.

    Although Cardona Llorens welcomed the progress made to guarantee children in Panama the right to enjoy a protected childhood, he highlighted failures such as the lack of a protocol regarding the sale of children, child prostitution and the use of children in pornography.

    “They have owed it to us for 14 years since, 2003,” said Cardona, who stressed that Panama is the only State in the region without a law that guarantees a protective vision of childhood.

    “When are you going to bring out that law that has been going on for more than 10 years? What are the obstacles to approval? Where is that integral strategy they talk so much about? Will not they do it until they have the law? Cannot you go ahead? “asked the UN expert.

    Another of the failures of the system that earned  UN recrimination for Panama was over public resources diverted because of corruption. “They detract resources for corruption and Panama has had many cases. What measures are adopted now to avoid this? asked Cardona.

    Panama’s  representative Yazmín Cárdenas Quintero stated that her government has proposed

    to “fight against corruption at all levels”.  And she promised more information before the closing session on Thursday.

    AN INTERNAL disciplinary investigation has been opened in Panama’s Supreme Court after a file containing documents relating to a high profile criminal case were found on a public highway drawing spotlights back to a criminal case with a cast of high profile suspects.

    A driver whose car was grazed by a Harley type motorcycle picked up an envelope apparently dropped by the driver of the motorcycle. It contained a file covering the  Financial Pacific  (FP) case and adds one more twist to the tangled story surrounding the failed brokerage, which reads like a TV whodunnit series.

    It includes: the sudden disappearance of an auditor who uncovered irregularities; the stabbing of another investigator; a Watergate style  burglary at the FP office; the flight and reappearance of a Brokerage Superintendency manager, now jailed; money laundering; a prisoner claiming knowledge of the murder of the auditor:  a brokerage employee  alleging ex-President Ricardo Martinelli was behind a “High Spirit” account used to manipulate shares of a mining company; allegations that then Attorney General  Ayu Prado  persuaded her to change her story; visits to her detention cell by a Martinelli Minister promising release if she recanted; the appointment of  Ayu Prado to the Supreme Court where he is now president: the disappearnce from Panama of FP’s founders; one turned up in the Domnican Republic  for his higly publicized wedding. He was arrested and is now  in El Renacer Prison, There are two major upcoming criminal trials involving FP and a host of former members of the Martinelli inner circle.

    A Supreme Court Judge has visited Toronto seeking support from judicial authorities in the share manipulation thread.

    The files, that bring the saga back to front stage were extracted from the Seventh Criminal Court and were, a charge of Judge Felipe Antonio Fuentes López.

    On  Wednesday, January 17 in a meeting held by Ayú Prado with the magistrates of the Second Superior Court it was agreed that  Judge Secundino Mendieta current president of the Second Superior Court- will be the “link” in any legal proceeding by the Attorney General’s Office (PGN).

    On Tuesday, January 16, the PGN made an inspection in the courtroom, one day after the car driver retrieved the file at Loma Cová. The driver took the documents to the journalist Álvaro Alvarado,  who showed them on the Telemetro News.

    Stay  tuned, the series isn’t over yet and  there will be more twists and turns as the main players try to avoid justice

    AN INTERPOL   Red Alert to locate and arrest a former director of contracts at Panama’s  Ministry of Public Works  (MOP)  has been sought by The Seventh Anti-Corruption Prosecutor.

    The wanted man is Jorge Churro Ruiz, Director of Contracts Administration of the (MOP) during the management of Federico José Pepe Suárez.

    Ruiz, from Spain, is a key figure in the Blue Apple bribery case. On Monday, Jan, 15.  Attorney General Kenia Porcell, said that “in the case of the MOP, it was the director of public contracts who asked for bribes “.

    On September 30, 2011,  MOP  Minister Súarez, signed three resolutions authorizing authorized Ruiz and two engineers to represent the MOP, review, approve or reject partial payments for work progress in three megaprojects: the road reordering in Panama City, the widening of the road Domingo Díaz (via Tocumen) and Cinta Costera  3.

    The road reordering plan, which included the construction of vehicular steps, interchanges, asphalt and multi-way bagging, was awarded for $1.5 billion.

    Conalvías obtained one of the contracts, for $21 million.

    The expansion of Domingo Díaz, was by the ICA-Meco consortium, was awarded for $237 million, Cinta Costera  3, executed by Odebrecht, was for $780 million.

    The sublease contract for 1,300 farms signed between Del Monte and the Panamanian government will allow banana production to start in Barú, Chiriqui.

    The contract for the sub-leasing of more 1,300 farms for reactivation of banana production in Barú, province of Chiriquí, was signed on Monday by the Minister of the Presidency, Álvaro Alemán and the vice president of operations for Latin America of the company Del Monte, Jorge Pelaes.

    The agreement, for 20 years, extendable, and for an amount of 9.9 million balboas, involves farms in Mango and Juabito, which will be the first to be used to start producing and exporting bananas.

    The German minister stressed that there are only a few steps left for the Del Monte company, through its subsidiary Banapiña S.A., to begin operations, including: obtaining an endorsement from the General Comptroller of the Republic and the Environmental Impact Study from the Ministry of Environment.

    One month after its license was canceled, a judicial ruling has reactivated the project to construct and operate a 670 MW natural gas plant, under the responsibility of NG Power.

    With the ruling from the Supreme Court of Justice, the cancellation of the license to build the 670 MW thermoelectric plant, announced in December 2017 by the National Public Services Authority, is now null and void.

    "... With this ruling, other decisions taken by the National Authority of Public Services (ASEP), which had denied the possibility of extending a period of 150 to 270 days for the company to present the economic backing for the work, are also left without effect."

    From this moment, the authorities at Panamá NG Power "... have 150 days to demonstrate that they have the strength to continue with the project. This period will begin to take effect from the moment the judgment is signed and the measure is notified to the ASEP, which up until yesterday claimed to be unaware of the ruling and, therefore, would not be making any statements regarding this matter."

    José Dapelo, President of Panama NG Power indicated that "... Our position is simple, all projects (for gas generation in Colon) must be realised. There should be fair competition and rules should be respected for everyone. Our project is much more efficient than the competition given the size and quality of the turbines'."

    THE FORMER Vice President of Factoring and Surety of Global Bank, Joaquín Rodríguez Salcedo, a key figure in the Blue Apple bribery scandal appeared for his third grilling by the Sixth Anti-corruption prosecutor on Tuesday, Jan 16.

    This was confirmed by his defense attorney Gladys Quintero at the Avesa building, headquarters of the Prosecutor, Aurelio Vásquez, to whom Rodríguez Salcedo explained the commercial structure he worked with lawyer Federico Barrios who he remains in preventive detention as is his wife Ana Mercedes Briones.

    The extension of the interrogation  Rodriguez Salcedo came the day after  Attorney General, Kenia  Porcell revealed details of the investigation involving 33 people including ex-Martinelli era ministers.

    A  SPEEDING heavy truck hit and crushed a taxi sending both vehicles into a ditch with no fatalities to add to this year’s total of 15.

    The spectacular accident happened at 8 a.m. on  Monday, Jan 15 Bajo Grande, in the district of La Chorrera.

    Residents arrived to help the two injured people in the taxi and 911 paramedics took them the Emergency Room of the Nicolás A. Solano Hospital, where they were stabilized.

    A MONEY-LAUNDERING hearing involving former Vice President Felipe Pipo Virzi, and 11 others was suspended for the second time by the  Eighteenth Criminal Court on Monday, January 16.

    Virzi, involved in several corruption cases has a track   record of staving off hearings and convincing judges to release him from preventive detention,

    The preliminary hearing was for alleged money laundering through funds from a loan granted by the  State savings bank, Caja de Ahorros (CA) to the HPC-Contratas P & V consortium.

    The loan was granted for the alleged construction of a convention center in Amador, but the

    money finally went to the accounts of the extinct Financial Pacific (FP) brokerage The hearing was suspended because the defense of Jose Isaac Virzi, brother of the ex-vice president filed a writ of habeas corpus last week before the Supreme Court and it has not yet been decided.

    The hearing was originally set for December 12, but the eighteenth criminal judge, Baloisa Marquínez, ordered the suspension for a habeas corpus presented by Pipo Virzi.

    In addition to the Virzi brothers,  nine others are facing trial including former FP directors -West Valdés and Iván Clare who are facing trial over the High Spirit Account at the brokerage.

    This process began after the Public Prosecutor opened proceedings against former members of the Board of the Savings Bank – chaired then by Riccardo Francolini- for presumed embezzlement, in the loan approved to HPC-Contratas P & V. Pipo Virzi, his partner Ricardo Calvo and Jason Pastor are also investigated in the latter case along with Rodrigo Arosemena Pino, former manager and deputy manager, .of the CA

    Details of the operation of the multi-million  “Blue Apple” bribery scandal involving cabinet ministers and officials of the Ricardo Martinelli administration land local construction companies were laid bare to media on Monday, January 15, by Attorney General Kenia Porcell.

    Thirty-three people have been hauled into the Public Ministry anti-corruption net and an investigation has been opened into the  Financial Analysis Unit (UAF), which failed to take action when three local banks reported suspicious transactions.

    Later millions of dollars were transferred to Hong Kong, The Virgin Islands, Switzerland and the United States for the benefit of the corrupt officials.

    Porcell said the highest officials of the Ministry of Housing and Territorial Planning (Miviot) and the Ministry of Public Works (MOP) demanded that construction companies pay bribes of between 5% and 10% to “expedite administrative procedures” between 2010 and 2011.

    The  MOP  Minister was Federico Suarez and in the Miviot Carlos Duboy, who resigned after the break-up of the alliance in August 2011.

    Porcell said the officials who are still being investigated “have electoral criminal jurisdiction” and the Electoral Tribunal is being asked to lift it.

    The bribes were made through the paper company Blue Apple Services, S.A. (BAS), which handled about $40 million in five bank accounts, in three local banks:  Banco General, Capital Bank and Banesco.

    So far $20 million in cash and  $5 million in assets such as villas, apartments and cars has been recovered,  said Porcell. In addition, $9 million has been detected outside the country.

    Seven companies are investigated: Conalvías. Meco, Conceptos y Espacios, Bagatrac, Constructora Rodsa, CS Constructores e Ingeniería Rec.

    Their representatives have surrendered to investigation and have identified to whom the money went, who was part of the organization, the destination of the profits, in addition to returning the illicit money.

    In addition, five effective collaboration agreements have been made, of which three have been validated.

    For alleged money laundering, 21 persons are investigated, of which three are in preventive detention.  Money laundering is punishable by five to twelve years in prison.

    The company Blue Apple Services (BAS) was incorporated on May 23, 2011, in Panama and dissolved on August 23, 2013.   The  company served as a front for receiving and introducing illicit money into  legal economic traffic (laundering).

    A savings account in Capital Bank was opened for $1 million. In the same bank, another current account was opened for $12.5 million. Capital Bank also opened two fixed terms: one for $2.3 million and another for $ 500,000. In Banco General, one was opened for $11.3 million and one in Banesco for $13 million.

    The banks ordered the closure of the bank accounts after considering that the operations were unusual and out of transactional profile and alerted the Financial Analysis Unit.

    David Diaz, Assistant General Secretary of the MP, said “Up to this moment we have not been able to identify any report or any action of the UAF to the MP at that time, and we have initiated an investigation.”

    THE ATTEMPT to remove  Donald Trump’s  hotel company from the management of the hotel in Punta Pacifica has turned into a bitter dispute with accusations of bad financial practices, and pressure exerted on the Marriott Hotel chain by the Trump organization.

    The hotel and apartment complex has been mired in problems since it was constructed in 2011, with a bankruptcy,  purchasers of units involved in multiple lawsuits, and vendors accused of fraudulent practices.

    From the start, it has had problems selling sections. Occupancy rates are so low that some owners do not receive income from their properties and they must pay the maintenance costs out of their pockets.

    Last week Trump Hotels staff ordered a team of Marriott managers out of the building, where they were staying as guests while the search is underway for a new manager, according to people familiar with the matter, report numerous US media.

    The hotel’s owners accused Trump Hotels of unfair management and financial malpractice in a $15 million arbitration claim. The company owned by the president of the United States responded with a $200 million counterclaim and refused to deliver the property accounts.

    According to two sources, the head of Trump Hotels, Eric Danziger, called the CEO of Marriott, Arne Sorenson, to complain about the visit. In general, Marriott avoids property with disputes between owners and managers. But the call from a senior manager of Trump to the CEO of Marriott, who manages over 6,000 hotels raised the awkward question of how American companies interact with a business owned by the president.

    Like many international companies, Marriott has raised business issues and interests on regulations with the Trump government.

    Federal employees who travel and offer conferences for the government paid to use their properties and Marriott has put pressure on the government and Congress on tourism issues, trade and legal restrictions on properties in Cuba, among other matters.

    The legal advisor to the Trump Organization, Alan Garten, said Sorenson did not pressure Marriott. “They appreciated that we explained to them that we have a valid contract.”

    The issue highlights the potential ethical issues raised by Trump’s decision not to divest from their business, said Larry Noble, head of the Campaign Legal Center, a Washington-based public interest group that studies issues about democracy. “I do not know if they have a valid contract or not,” Noble said. “But if you’re a big company, you’d really have to think twice before getting into a fight with one of the president’s companies, “he added.

    Since Trump took office, Trump hotels in New York and Toronto have reached discreet agreements to distance themselves from the Trump brand. But the dispute in Panama starts to look like a full-fledged fight says an Associated Press (AP) report.

    In a letter to other owners, the investor who heads the board of directors of the owners f the Panama building accused Trump Hotels of “brazen unfair administration, breaking of contract, illegal appropriation and breach of fiduciary duties “.

    “Our investment has no future as long as the hotel is managed by an  incompetent operator  whose mark has been stained without remedy, ”

    Orestes Fintiklis, managing partner of the Miami-based firm Ithaca Capital said in the letter that Trump Hotels refuses to keep its last vestiges of dignity and abandon our property peacefully.

    Trump Hotels, meanwhile, accused Ithaca of cheating the other owners and liquidating the contract illegally. “Unfortunately, it’s you, the owners, who will ultimately bear responsibility for the bad acts of the Lord Fintiklis and his henchmen, “wrote the executive vice president of  Trump Hotels, Jeff Wagoner.

    In Panama, the Supreme Court of Justice has annulled an environmental impact study for a wind farm with 75 wind turbines, which was planned to be built in the Fortuna forest reserve.

    Arguing that the Environmental Impact Study (EIA) should have been category III, instead of II, because it is within a protected area, the Third Chamber of the Court for contentious administrative proceedings decided to declare the resolution of 2014, "null for being illegal", a resolution which had approved the EIA submitted by the company Luz Eólica de Panamá.

    Representatives of the company questioned the ruling, "... since, according to them, they fulfilled all of the requirements demanded at that time by the Ministry of Environment, at that time, the ANAM. Who supports or protects investments in this country?, asked Manuel Armijo, representative of Luz Eólica."

    A 61-year-old educator and teacher activist  Robin Castillo was killed in the late afternoon on Sunday, January  14  when the vehicle in which he was a passenger was involved in a collision and rolled over. He was thrown through a door onto the roadway.

    The accident took place on the road to La Colorada de Santiago in Veraguas.

    Castillo a member of the Association of Veterans Educators (AEVE) was a prominent education proponent.

    SIXTEEN people were injured following a collision between a pickup and a bus, in Herrera on Monday afternoon, January 15. The incident took place at the entrance of Majarilla in Ocú.

    BAIL  bonds granted   to money laundering suspects linked to the  notorious High Spirit account at the failed Financial Pacific (FP) brokerage by the Seventh Anti-Corruption Prosecutor’s Office

    In a January 2, ruling, Judge Felipe Fuentes granted protection from arrest and detention to  Roberto Enrique de La Espriella, Jesús Veleiro Carballeda and Gumersindo García Dominguez, with bail not to be arrested for $10,000 apiece. Teresa Sánchez De Abood, Carlos Javier Osorio Wald, Joshua Absalon Chavez and Mariel Rodriguez Espino got the same deal for $100,000 thousand each.

    All are charged for with  money laundering and financial crimes

    The prosecution questioned the amount of bail assigned by the judge because it considers them not reasonable with the high sums of money in the High Spirit. account transactions

    According to the prosecutor’s office, there were transactions in and out of the account of $1 million, $2.9 million and up to $4 million of monies from alleged financial crimes of the Panamanian securities market system with the appearance of legality.

    Among the beneficiaries of the bonds are Roberto De La Espriella, Jesús Veleiro Carballeda partners of the law firm Veleiro, Mihalitsianos & De La Espriella (VM & E), which deposited almost half a million dollars in the High spirit account without justifying the origin of money.

    Gumersindo García Dominguez figured as director/president of the account; Teresa Sánchez De Abood and Mariel Rodríguez Espino were compliance officers in FP; Jossue Absalón Chávez and Carlos Javier Osorio Wald had managerial positions.

    The prosecution has also laid charges for alleged money laundering and financial crimes against West Valdés and Iván Clare, ex-directors of FP.

    In addition, there are charges against Ori Sasson Zbeda, Aaron Mizrachi Malca, Navin Mohan Bhakta, Tse Yum Ling and Miguel Mihalitsianos.

    Mizrachi and  Clare have fled the country.
