Carlos Duboy,  the director of Tocumen, S.A.  the company that runs Panama’s international airport has an “obvious conflict of interest.” and should resign says Transparency International (TI) following revelations of political donations from Odebrecht which is building the airport’s second terminal.

He cannot continue in office, it’s not that the law obligates him, but an ethical issue makes it imperative that he do it “, said Lina Vega Abad, president of the Foundation for Development of Citizen Liberty, Panamanian chapter of TI.

Duboy,  who is treasurer of the  ruling Panameñista Party,  in an interview with La Prensa,  on Monday, December 11 admitted that in 2008, when he  served as sub-treasurer  he  knocked on the company’s doors for donations to the campaign of Juan Carlos Varela, and they made  two: one for $50,000 and another for $100,000,  money received by Strategic Management Group, his family company.

Vega Abad said that since the name of Duboy came out in the first revelations made by Jaime Lasso, former Ambassador of Panama in South Korea, about other Odebrecht donations.

She said that one of the most serious issues to be corrected in the country is the conflicts of interests.

“And the Duboy case is a perfect example because it’s totally unheard of for a person who was coming out for the donations, as the contact between the party and Odebrecht, followed managing a project that Odebrecht was carrying out at the airport.”

Step back
She added that at that moment what Duboy had to do was “take a step back and leave the administration to another person. Now the situation is more serious because he is saying that his relationship comes from further back…to the party primaries for the 2009 elections. And obviously he cannot stay there, he cannot continue in that position. ”

According to a report from the Judicial Investigation Directorate, Odebrecht gave $10 million to the former Ambassador Jaime Lasso, between 2009 and 2014, funds that would have gone to the Panameñista  Party.

WHILE PRESIDENT Varela has backed away from replacing Carlos Duboy, manager of Tocumen, S.A, in spite of calls from civil society and Transparency  International.   The  Administration Attorney General of the Administration, Rigoberto González, has recommended his removal.

Duboy, the current treasurer of the ruling Panamenista party admitted on Monday that he requested a donation from the Odebrecht construction company in 2008.

According to the prosecutor, although Duboy is not appointed within the central government if he is in charge of a State society there could be a conflict of interest since the Odebrecht company

develops the airport expansion project. He added that Duboy can apply the Code of Ethics of the officials. “Faced with that, the minimum that one has to do ethically is to separate from the position so as not to tarnish and not leave in question his performance, however laudable, “said Gonzalez.

ODEBRECHT, The Brazilian Construction  Company that gave major election campaign donations to the Panamenista Party via the man who is now manager of Tocumen SA . and the party’s   treasurer will be disqualified from bidding on upcoming airport contracts.

Carlos Duboy,  in the eye of a conflict of interest storm after confessing to knocking on Odebrecht’s door for donations, and now facing calls for his resignation from his post at the airport has assured that his administration will follow the guidelines established by the Executive, which disqualify the company from participating in public tenders. Reports La Prensa.

“We have spoken with the contractor about the impediment they have to attending the tenders for Tocumen, “said Duboy, who since April has been leading the terminal operations.

Engineers of the company, involved in one of the biggest corruption scandals

in Latin America over the payment of bribes to get state contracts, participated this month in two approval meetings held by the airport, as part of the process to bid for two contracts that total $8.8 million.

Duboy said that “having attended a certification meeting in the past week does not mean that they are going to present an offer or participate in a tender “, and added that if they did they would be disqualified.

Panama’s Administration  Attorney General, Rigoberto González, was more emphatic, reports La Prensa and said that the company should not participate in any public act, and should refrain from carrying out any management related to public events.

President Juan Carlos Varela has resisted calls for Duboy’s resignation after admitting to asking Odebrecht for donations to the ruling party’s campaign.

Tocumen International S.A,  Director Carlos Duboy under a cloud since Transparency International and other civil groups called for his firing, resigned on Thursday, June 7.

Duboy announced that he submitted his resignation effective July 16. to President, Juan Carlos Varela, and to the Minister of Economy and Finance, Dulcidio De la Guardia, who is the chairman of the board of Tocumen, S.A.

Duboy  said  he resigned because of politics and that on  July 3 he will hold  a press conference for the rendering of accounts of his years of management at the head of Tocumen, S.A.

He is a member of the ruling Panameñista Party and was the center of a controversy last year when it was revealed he sought  a donation from the Brazilian company Odebrecht in 2008 which has been the recipient of billions of dollars of government contracts, including Terminal 2 at Tocumen International Airport.

According to a report from the Judicial Investigation Directorate, Odebrecht gave $10 million to former Ambassador Jaime Lasso between 2009 and 2014.

The funds, which would have reached the Panameñista Party, were donations “in kind” and received by Lasso, according to Duboy.

In an interview with La Prensa, on Monday, December 11, he admitted  that

Odebrecht gave him two items: one for $50 thousand and another for $100 thousand, funds received by Strategic Management Group, his  family company.

Several sectors of civil society requested that he be separated from his position, among them  the Panama chapter of Transparency International, which said that there was a conflict of interests.

The Special Anti-Corruption Prosecutor's Office,  investigating the  Odebrecht bribery scandal  has requested new information from the Electoral Tribunal (TE)  involving the  former   head of state-owned Tocumen SA

Prosecutor Tania Sterling asked the electoral authorities on September 16 to inform her if the Panameñista Party , as well as former president Juan Carlos Varela registered donations received by the Strategic Management Group Inc., whose legal representative is Carlos Alberto Duboy , former manager of airport  and former Panameñista treasurer

Varela and Duboy are with alleged  money laundering.

According to the Public Ministry, Strategic Management Group Inc., received on October 2, 2008 $50.000 from the Constructora Internacional del Sur, one of the companies that Odebrecht created to distribute bribes.

Almost a month later, on October 30, the same company received another $99,852 dollars with 95 cents from Klienfeld LTD, also used by Odebrecht to make backdoor payments..

Dubey has said that the money was to pay debts from the political campaign of the 2008 primaries, in which Varela was elected as the presidential candidate of the Panameñista Party.

In Duboy's investigation order, it says that the prosecution found in the Public Registry that Strategic Management Group Inc. was registered on October 19, 2006. The law firm Acosta, Fábrega, Vásquez & Asociados also gave witness to this. Supposedly, it was created to give seminars and consultancies to companies.

The file also contains the sworn statement of the attorney Katia Fábrega Vergara, who maintained that, at Duboy's request, she became a resident agent of the company.

Recently, prosecutor Ruth Morcillo sent an official letter to the TE in which she requested an authenticated copy of the documents that contain information, notes, certification or authorization in favor of the Panameñista, to import, with the right to tax exemption, promotional material through from Rekhatex (HK) Limited, Hong Kong, for the 2014 season. In those elections, Varela was the Panameñista's presidential candidate.
