Collaborative Economy Regulations

In Panama, a bill seeks to regulate messaging services offered through technological platforms, such as UberEats, Appetito 24, Glovo or Domicilio Don Juan.

The platforms of digital messaging services, such as transport activity, will be regulated, according to the essence of Draft Law 179 proposed in the Transport Commission, informed the National Assembly on October 14. See proposal submitted.

Article 5 of the bill states that "... Companies engaged in providing digital messaging services will have the following obligations:

a.  Obtain a copy, in digital or physical format, of the identity document of all those distributors that provide Digital Messaging Services.
b.  Obtain a copy, either in digital or physical format, of the driver's license that authorizes to drive the vehicle by means of which the digital messenger service is provided, in accordance with the provisions of the Transit and Land Transportation Authority for each type of vehicle.
c.  Obtain from the deliverer, either in digital or physical format, a copy of the ownership documents of the vehicle used to carry out the digital messaging services.
d.  Obtain from the deliverer, either in digital format () physical. copy of the insurance of the vehicle used to provide the Digital Messaging Services.
e.  Those Companies of Digital Messaging within the services offered is the delivery of food of any kind, must obtain from the distributor. either in digital or physical format, copy of green and white health card, according to the requirements demanded by the Ministry of Health of Panama.
f.  Give the delivery man at least personal protection and security equipment.

"... Companies subscribing to the service provided by the Digital Messaging Companies must comply with the following obligations:

a. In the case of companies providing food services, they must ensure that all food shipped to the deliverers of the digital messaging companies contains a security seal or sticker. which gives certainty to the customer that their product has not been tampered with,
