8-year-old to become Panama’s youngest mother

An 8-year-old girl with 25 weeks of gestation has been in the maternity wing of the Santo Tomás Hospital (HST) for approximately a week reports TVN. Her pregnancy was revealed when she was taken to a Health Clinic for a check-up.

Man charged with rape of 8-year-old

A man charged with the alleged rape of a minor under 8 years of age who became pregnant, is in provisional detention said the Public Ministry (MP) on Wednesday, February 23, following a TVN Noticias report – of the care that the minor has received from the Santo Tomás Hospital and the Children's Hospital.

The MP reported that on December 29, 2021, a guarantees hearing was held for the man, for the alleged commission of the crime of aggravated rape.

In the statement, the MP pointed out that it is necessary to guarantee the comprehensive protection of the minor – of the Guna ethnic group – “avoiding the victimization generated by these publicized facts.”

In a statement, the National Secretariat for Children, Adolescents and Family (Senniaf) reported that since December 27, 2021, it has provided, through a measure of protection and deprivation of parental care issued by the Second Court for Children and Adolescents, the approach regarding the protection of the victim, "proceeding immediately by the technical staff of the Protection Directorate, to remove her from the family unit where the aggressor was."

Lawmakers ignore 7,000 annual sexual crimes against children

The recent case of the rape of an 8-year-old girl who, moreover, was impregnated by her perpetrator – a close relative of hers – reveals the serious state of our society. The National Assembly is cross-armed on sexual education and has been tremendously permissive in situations like these, since there is little protection for victims, not to mention that education, in general, has been degraded to the point that we have a schooled society, but of questionable quality, lower with each passing year.

The State urgently needs reforms in this matter to really offer help and protection to the victims of abuse. The existing and updated data is terrifying; 7,000 annual complaints of sexual crimes: that represents an average of 20 a day, that is, almost one sexual assault every hour. This is a serious problem in which the Government does absolutely nothing, not to mention the fact that such a number of complaints far exceeds the capacity of the Public Ministry and the Judicial Branch to process them, creating a judicial backlog. In short, sexual assaults are increasing and the Executive does little to reduce them, more than just pointing out the problem is urgent while these cases overwhelm the capacity of the Judiciary – LA PRENSA, Feb. 25.

Five Panama girls under 14 became mothers for the second time

In 2020 some 392 girls under the age of 14 conceived their first child and the in the last 16 years, some 305 had a second child before turning 15 years old, five of them in 2020, according to figures from the comptroller’s office.

The cases hide abuse and dysfunctional family dynamics seen by them as something normal says a La Estrella investigation.

 The Sex Education Law is still pending but the reality that Panama is experiencing is reflected in the data published, through the National Institute of Statistics and Census (INEC). The figures correspond to the administrative records of public health facilities (Ministry of Health and Social Security Fund), private clinics and offices of the Civil Registry (Electoral Court).

The most recent case is that of an eight-year-old girl who was raped and is in her 25th week of pregnancy. The abuser is in custody and has already been charged with rape since December.

The general fertility rate revealed that in the country there were 64.1 live births per thousand women of childbearing age when comparing the data with the previous year, a decrease of 4.5% was observed; On the other hand, the global fertility rate establishes a ratio of 2.1 children per woman, an indicator that decreased 4.4% by 2020.

In relation to the age of the mother, 15.9% of live births correspond to mothers under 20 years of age. , and for the districts of Panama and San Miguelito, 2.8% and 0.8%, respectively.

Appalling backlog in sexual assault hearings

The statistics on sexual assaults in Panama are as appalling as the crime itself. Between 2016 and 2021, almost 37,000 complaints of sexual offenses have been filed. That gives an annual average of just over 6,000 and 17 complaints per day. Such a number of cases has exceeded the capacity of the Judicial Branch, since in the same period, only slightly more than 25,000 hearings have been held, or an average of only 11.4 daily hearings.

But of those more than 25,000 hearings, only 3,990 have been “resolved”, that is, about 16% of the total cases, of which more than half (56%) have ended in suspension. of the processes or in dismissal or in their prescription. These figures tell us that in Panama there is a huge judicial backlog, with a drag of years in this type of crime.

The other thing that warns us is that, in addition to the delay, there is enormous impunity, judging by the "resolved cases", many of which have ended in prescription. It is evident then that we have serious problems in guaranteeing people's sexual integrity, given the serious problems we face. Eight-year-old mother and baby find a home

Call for probe of decisions leading to birth by 8-year-old

Various organizations, lawyers, activists, and human rights defenders filed a complaint on Friday, March 4, with the Public Ministry (MP), in order to open an investigation to examine "all the actions" that have taken place in the case of the eight-year-old girl who became pregnant after sexual abuse by a relative.

On Wednesday, March 2, the minor gave birth – by means of a cesarean section – to a boy, who remains in the intensive care room.

"This is a situation without parallel in the Republic of Panama," said Gilma De León, from Fundagénero, at the MP's headquarters.

For this reason, De León explained that they are looking for a thorough investigation to be carried out to see if there has been due diligence in the officials who have had to deal with this case, both from the Ministry of Health, as well as from the Santo Tomás Hospital and the Hospital del Nino.

"I think it is a responsible action to open the possibility of establishing whether our current regulations on the possibility of abortion have been complied with," the lawyer said.

She stressed that it is “obligatory” that women's organizations take action so that the MP shows that “it may be capable of opening a file” and see if due diligence was given in the case.

"Citizens and the entire country demand answers, demand forcefulness in the scope and application of justice and demand that, once and for all, no girl or adolescent be forced to give birth, or to be a mother," said a statement of the various organizations.

12 years for rape of minor in government childcare

A sentence of years in prison has been handed down to Bolívar Lanuza Araúz for the crime of rape and libidinous acts to the detriment of a minor. In addition, four officials from the National Secretariat for Children, Adolescents, and Family (Senniaf) were charged with child abuse.

The investigation dates back to August 2020 when the Public Ministry initiated proceedings on the transfer of a group of minors from a shelter to a rehabilitation center.

The investigation revealed that at least one minor was raped and subjected to libidinous acts by an inmate, for which he was charged.

At the same time, the Specialized Family Section of the Metropolitan Prosecutor's Office charged four Senniaf officials with crimes of mistreatment of minors, for having allowed the transfer of minors to the rehabilitation center, being a place not suitable for the shelter of children and underage girls.

Interpol red alert follows sexual exploitation probe

A two-day diligence in a shelter and in several communities located on the border between Panama and Costa Rica, to collect information on the 5 minors, possible victims of human trafficking, was carried out by specialists in psychology and social work of the Ministry of Public Security together with the Prosecutor's Office against Organized Crime and the support of the National Border Service.

The minors were rescued in the Binational Operation between Panama and Costa Rica, called "Luz de Esperanza".

Justice  of Peace charged with rape of a minor

American citizen Robert Ryan Friedler, 43,  has been found guilty of aggravated rape, corruption of minors, and libidinous acts, to the detriment of eight children, in Palmira in the district of Boquete, Chiriquí.

Eight minors revealed to the court that the North American gave them cell phones and computers to play with,  and he put them to watch adult movies and abused two of them, which were certified with forensic tests.

The prosecution also managed to certify that the other six minors were victims of libidinous acts, acts committed in April 2019, in Palmira Boquete.

Some 57 witnesses gave their version of the events in an oral trial that lasted seven days.

Friedler is awaiting the sentence to be imposed by the magistrates of the Court, The Public Ministry was represented by prosecutors Ladys Palacios, Carlos Alvarado, and Eva Monrroy.

Reports from the DIJ were shown during the trial where an attempt was made to bribe the parents of several of the children, who testified that they were approached by a citizen of Colombian origin, the same person who was later presented as a witness for the defense of the foreigner.

The case began in the community of Palmira, district of Boquete after several complaints were filed by parents of minors against the accused before the district Personería.

Priest gets 5 years jail for sex acts with minor

Community service order for libidinous priest revoked

The measure to replace  60 months of jail time with community work for a  Catholic priest was revoked Thursday, July 14, during an appeal hearing.

The Public Ministry reported that the Court of Appeals confirmed the sentence of 5 years in prison for the priest, Luis Ruiz Quiroga, convicted of libidinous acts to the detriment of a minor under 17 years of age.

He was denounced on June 30 and faced a hearing on July 5 and was sentenced.

However, his defense asked for the sentence to be replaced by community service

According to the Judicial Branch, the judge observed during a hearing that the sanctioned person "meets the necessary requirements in terms of functions, hours and supervision."

For this reason, she granted the replacement of the sentence, a measure that was appealed by the Second Section of Crimes Against Freedom and Sexual Integrity of the Metropolitan Prosecutor's Office.

The 51-year-old priest worked in the Cristo Redentor Church, in San Miguelito and previously in the Espiritu Santo parish on December 24. He was removed from his post, the Archdiocese of Panama reported in a statement.

Second arrest in sexual trafficking probe

A second person allegedly involved in a network of trafficking in women for sexual exploitation operated in Paitilla and via Argentina has been arrested by officials from the Public Ministry and the National Police.

The man, of Italian nationality, was arrested at  Tocumen International Airport, as he was boarding a flight to Costa Rica.

In diligence carried out on Wednesday, the First Prosecutor's Office Against Organized Crime seized more than $10,000 dollars in cash, in the apartment the man occupied in the San Francisco sector.

This was the second arrest in the  "Galaxy" operation after a man was arrested Sunday presumed to be in charge of the custody of the six Colombian women who were allegedly subjected to sexual exploitation.

The Colombian, identified as Jhonatan Ocampo, has already been presented before a guarantee court and is in preventive detention.

The Prosecutor's Office stressed that it is on the trail of other possible members of the criminal network.

More victims of sexual abuse in children’s shelters join lawsuit

PANAMA CITY/ 27 new victims have joined the civil lawsuit that 35 people filed several months ago against the NGO Global SOS Children Villages International, based in Austria, for alleged sexual, physical, and psychological abuse suffered at its headquarters in Panama, between 1980 and 1990, and for which they demand more than 43 million dollars as compensation.

Sexual exploitation of minors  network dismantled

A network dedicated to the sexual exploitation of minors made up of about 11 people, including a corporal from the National Border Service (Senafront) and government officials, was dismantled on Monday, July 24, by the Judicial Investigation Directorate (DIJ) and the Public Ministry.

An official from the Social Security Fund and another from the Ministry of Education were arrested, confirmed prosecutor Giselle Acosta.

Operation "Trillizas" took place in the provinces of Chiriquí and Darién, in which three minors who were allegedly sexually exploited were located.

Prosecutor Acosta said the investigation began in December 2022, when the minors became pregnant and went to a health center where one of the victims reported that the baby's father was a person who paid to have sexual relations with her. The information was forwarded to the Public Ministry.

In the investigation, it was determined that the mother and father of the three minors had participated in the criminal act by advertising on social networks for which they were placed under the orders of the Public Ministry to determine their connection to the crime.

In the operation, 14 raids were carried out in Puerto Armuelles and Río Sereno in the province of Chiriquí.

While the Senafront official was detained at the checkpoint located in Las Lajas, Yaviza in the province of Darién.

According to the investigations, the official participated actively in the sexual exploitation network.

Child protection officials found guilty of child abuse

The Prosecutor's Office requested a sentence of 38 years in prison.

The Chiriquí Trial Court found him guilty and the magistrates will read the sentence on August 18.

The Prosecutor's Office requests a sentence of 180 months for aggravated rape; 144 months for exhibitionism 144 and 72 for lewd acts.

The events occurred on April 11, 2021, and the complaint was filed in October of that year.

Man linked network of child sexual exploitation arrested

The National Police reported  the arrest on Tuesday, August 29,  in  San Miguelito, of a man suspected of links  to an international network of child sexual exploitation

Technological equipment such as computers, hard drives, and cell phones were confiscated with suspected child abuse material.

The teams seized more than 1,000 images and videos of child abuse.

With the international operation Aliados por la infancia, where Argentina, Brazil, Chile, Costa Rica, Ecuador, the United States, Panama, and Paraguay participated the Police sought to dismantle a network dedicated to the transmission and production of sexual abuse material against children and teenagers.

 Between 2019 and 2022, Panama in the "Luz de infancia" operation some 40 people were investigated and 17 of them were convicted.

The National Police made a second arrest in  Chorrera, Panama Oeste, on Saturday, September 2 as part of the ongoing International Operation Allies for Children, also carried out in Argentina, the United States, Brazil, Chile, Ecuador, Paraguay, and Costa Rica.

The action was carried out, through the National Directorate of Police Intelligence, in association with the Public Ministry.

This is the second implicated in the international network who was arrested in Panama. According to official reports, he is a 29-year-old man who was inside a residence located in the El Harino sector where technological equipment was seized and inspected by experts from the Institute of Legal Medicine and Forensic Sciences and where alleged material of child abuse was found.
