The trial against Oydén Ortega Collado and Claudia Purcait, for the alleged sale of judgments in the Supreme Court began  on Thursday when  César Alvarado Taylor the man who denounced that he had paid sums of money to Ortega Collado, son of the former magistrate Oydén Ortega Durán , to obtain a favorable sentence in a land dispute took the stand

Alvarado Taylor said that he received multiple text messages from Ortega Collado, in which he assured him that in exchange for money he could solve the civil litigation for the purchase and sale of eight farms in Chiriquí.

He stated that they requested payments of between $5,000 and $15,000 for the admission of an appeal to achieve a favorable ruling on his claims. He acknowledged before the judges conversations, via WhatsApp, and emails exchanged with Ortega Collado, in which he assured him that he had to make a series of deposits to achieve the admission of the cassation, and that he had the consent of Hernán De León .

De León and Ortega Durán were magistrates in the Civil Court when the reported events took place.

In his statement, the complainant also detailed that the son of former magistrate Ortega Durán informed him that they should meet with Claudia Purcait, his father's secretary, "to reconcile information about the process," because "things were tangled." He said that Purcait asked him for details of the process, because the case was very involved.

Alvarado Taylor explained that he received a copy of a draft ruling that was favorable to him, but that he was later told that in order to decide the merits of the case, he had to pay more money. He reported that in this situation and seeing that his case was not advancing, he went to the National Assembly and filed a complaint against Ortega Durán and De León, but it was shelved.

He then decided to report the alleged sale of a judgment to the Public Ministry, where he admitted that he had paid money to obtain a judgment in his favor.

Son and assistant of former Supreme Court Judge guilty of influence peddling

Oydén Ortega Collado and Claudia Purcait, the son and secretary of former Supreme Court Justice Oydén Ortega Durán, were found guilty of influence peddling by the unanimous decision of three judges on Friday, March 11, and will be sentenced on March 25.

During the trial, which began on March 8, anti-corruption prosecutors Leyda Saénz and Elvis Coronado presented before the judges a wealth of evidence that showed that those under investigation carried out a series of actions to get the magistrates of the Court to issue a favorable ruling. in a dispute over eight pieces of land in the province of Chiriquí.

Judges Ilka Castillo, Jennifer Saavedra, and Roberto Tejeira, unanimously, gave a guilty verdict for both defendants for having managed the handling of a judicial ruling that was in the Civil Chamber of the Supreme Court.

One of the conclusive pieces of evidence presented by the prosecution reports La Prensa was the testimony of César Alvarado Taylor, who reached a sentence agreement with the prosecution and who was the person who denounced Oydén Ortega Collado and Claudia Purcait. He assured that they demanded the payment of money to obtain the admission of an appeal in the Civil Court that would be favorable to his intention to recover his land.

In his statement before the court, Alvarado Taylor reported that he made payments of $5,000 and $15,000 for the admission of the appeal, but that later a payment of $250,000 was required to reach a favorable ruling, but he desisted because he did not have that sum of money.

Lawyer son of former Supreme Court judge gets five years for selling judgments

A sentence of five years in prison for the crime of influence-peddling was imposed by a trial court on Oydén Ortega Collado  the lawyer son, of former Supreme Court Justice Oydén Ortega Durán.

Claudia Purcait, the assistant to the former magistrate drew a four-year sentence.

Judges Ilka Castillo, Jennifer Saavedra, and Roberto Tejeira, during the reading of the sentence on Friday afternoon, specified that Ortega Collado received money with the promise of obtaining a positive resolution of a court case and that he also had the collaboration of Purcait, as a primary accomplice to achieve these ends.

In Purcait's case, the judges decided to commute her sentence to a $5,000 fine.

The judges determined that the actions of both revealed the existence of a desire to circumvent the administration of justice, diverting impartiality to favor one of the parties.

The ruling recognized that from 2013 to 2014, Ortega Collado held talks with César Alvarado Taylor, to get the Civil Chamber of the Court to admit an appeal for annulment in a lawsuit involving eight farms of the Cerro Jesús Livestock Society, in the Chiriquí province, and that Alvarado Taylor made payments to Ortega Collado for this purpose.

During the reading of the sentence, the judges estimated that the anti-corruption prosecutors Leyda Sáenz and Elvis Coronado determined that Ortega Collado used his status as the son of a Court magistrate to try to obtain a favorable cassation for César Alvarado Taylor, in the aforementioned land dispute.

They also considered that Ortega Collado used his friendship with Purcait, who served as his father's assistant, to obtain a favorable verdict for Alvarado.

During the trial, the prosecution managed to establish that Alvarado made payments of $5,000 and $15,000 to Ortega Collado to obtain the admission of the appeal and that a favorable procedure is given to the merits of the judicial process.

The judges stated in the ruling that the defense of Ortega Collado and Purcait could not discredit the evidence provided by the prosecution, among which were a series of conversations, via WhatsApp, held between Alvarado and Ortega Collado, that gave details of the payments and the steps taken to achieve a favorable ruling.

The judges also explained that it was evidenced that the judicial process by which Alvarado gave money to Ortega Collado existed and that Purcait was the one who handled the issue of the admission of the cassation since she was the right hand of Judge Ortega Durán.

The judges ruled that the actions of Ortega Collado and Purcait hit the institutionality of the administration of justice since they tried to manage a judicial process through the payment of money, promoting corruption, and affecting the image of the administration of justice.

Orison Cogley, attorney for the former magistrate's son, announced that he will file an appeal.

The Judicial Branch announced yesterday the sentence to five years in prison for the son of a former magistrate of the Supreme Court of Justice, accused of selling rulings. Illicit was proven and a case was exposed. But is he the only one? Given the dubious references that our Supreme Court of Justice has, it is more than unlikely that this is the only one. So much so, that in this case the father of the condemned man was never tried, despite the fact that he was denounced in the National Assembly. And it is a disastrous coincidence that, while this sentence was being handed down, a decision was issued in the Electoral Court to prevent, precisely, that a former president of the Republic be prosecuted by ordinary justice, thanks to the fact that two of the three magistrates issued a ruling that saves him from it. Oydén Ortega Durán, magistrate of the Civil Chamber of the Supreme Court of Justice until March 2019, published an “open letter” to express his “outrage at the unfair sentence” that his son Oydén Ortega Collado received: five years in prison for influence peddling.

"He is paying the price of having a father who in all his public positions dared to act with courage and independence in the face of political and economic powers," said the former magistrate Ortega.

The letter circulated Saturday, March 26, one day after Ortega Collado and Claudia Purcait, who was assistant to Judge Ortega Durán in the Criminal Court, were sentenced.

Purcait was sentenced to four years in prison, which was commuted to a payment of $5,000. The judges specified that the son and assistant of Judge Ortega received money in exchange for manipulating a ruling, in a dispute over some land in Chiriquí. The businessman who made the payments reached a collaboration agreement with the Public Ministry and gave his testimony in court.

The former magistrate was also denounced for these events, but the National Assembly - which has the power to prosecute magistrates - filed the complaint reports La Prensa.
