    In the last 48 hours, Pamama’s Supreme Court of Justice has ruled on two legal appeals filed by lawyers of former President Ricardo Martinelli.

    Some71% of Panamanians questioned by the Gismo Services, SA in a survey, prepared for La Estrella de Panamá, disagree with the decision of the Electoral Tribunal to revoke an earlier decision to lift the electoral criminal jurisdiction of former President Ricardo Martinelli. The survey took a sample of 1,800 Panamanians in all provinces plus the Ngäbe Buglé region and was conducted between April 6 and 10.

    Judges Heriberto Araúz (speaker) and Alfredo Juncá endorsed the ruling arguing the existence of the specialty principle, by which the former president was extradited from the United States, so as not to be investigated for crimes other than the case of the punctures, in which Martinelli was found not guilty.

    The Supreme Court has confirmed a decision of the First Court of Justice that did not grant an Amparo of constitutional guarantees presented by former President Ricardo Martinelli in the New Business case, a process that follows the track of the purchase of Editora Panamá América SA presumably with public funds.

    The Court endorsed a decision of the First Court of Justice, which in turn upheld the decision of the third judge, liquidator of criminal cases, Baloisa Marquínez, not to accept a controversial incident against the inquiry order issued against Martinelli in the case.

    Martinelli's defense argued that Marquínez's decision violated the principle of specialty that he would enjoy and that it would prevent him from being prosecuted for a cause other than the puncture case, from which he was acquitted.

    But the ruling, which bears the signature of María Eugenia López, presiding magistrate of the Court, alleges that the alleged principle was invoked in the appeal filed against the decision of the First Superior Court, which did not admit the Amparo, but not so in the incident of controversy resolved by Marquínez.

    In addition, it indicates that the Amparo contains incomplete information on the appeals filed before the court and the First Court.

    On January 28, Marquínez was forced to suspend the preliminary hearing in this case, because Martinelli claimed to have criminal electoral jurisdiction due to the internal elections of his Realizing Goals party. Then Marquínez asked the Electoral Court (TE) to lift the jurisdiction of the former president, but the TE, through a resolution dated March 22, maintained that protection on the grounds that the accused would be covered by the principle of specialty. This decision of the TE is the subject of two claims of unconstitutionality before the Court, resources that were accumulated in one and whose rapporteur is López.

    In turn, Martinelli's defense denounced López before the National Assembly.

    Panama and US sign Letter of Understanding on migration

    The governments of Panama and the United States announced the signing of a "Letter of Understanding" on Migration Management and Protection of Migrants", in order to take action against the irregular flow of people through the region.

    The US Secretary of State, Antony Blinken, highlighted that the letter seeks to improve the management of irregular migration, expand stabilization efforts in favor of receiving communities and displaced populations, as well as increase the protection of migrants and their access to legal alternatives.

    The document was signed by the Minister of Security of Panama, Juan Pino, and the charge d'affaires of the United States Embassy in Panama, Stewart Tuttle, on Tuesday, April 19.

    Blinken, and the US Secretary of Security, Alejandro Mayorkas, participated in the Ministerial Conference on Migration and Protection in Panama.

    "This agreement on migration management and protection of migrants is part of the general framework of migration management agreements that the United States is currently developing with its counterparts on the continent," said Blinken.

    In mid-March, it was reported that 30% of the 8,456 migrants who crossed the Darién jungle between January and February of this year came from Venezuela.

    Last year 62% of migrants were Haitians, however,  but in 2022 they represent 13%.

    In 2022, Venezuelans displaced Haitians as the irregular migrants who enter the most through the province of Darién on their way to the United States.

    Five days after Realizing Goals (RM) will hold its elections to choose the directors of the Secretariats for Women and Youth, the president of that group, Ricardo Martinelli, notified the Electoral Court (TE) of the holding of an extraordinary national congress.

    Korean companies play major role in multi-billion metro expansion

    The Korean consortium HPH Joint Venture, which is building line 3 of the metro, will also design the tunnel that will allow the monorail to cross under the Panama Canal after the earlier choice of an American-led consortium failed to meet the requirements demanded by the Government.

    The selection of the group in which Louis Berger LAC participated generated a wave of criticism due to corruption cases in which the firm was mentioned.

    In March, the Minister of Public Works, Rafael Sabonge, reported that HPH Joint Venture would be in charge of the construction of the underground section of line 3, which will have an extension of 5 kilometers, and would be in charge of the design and execution of the civil works.

    Meanwhile, the civil works of the extension of line 2 to the Tocumen International Airport, are 93% complete and the installation of the railway system 79% advanced.

    The 2-kilometer connection with the new passenger terminal cost $150 million and will have a station at the Panama Specialized Higher Technical Institute (ITSE).

    The second project executed by the Metro in the capital city is the extension of line 1, from the San Isidro station, to the Villa Zaita sector. The work is the responsibility of the OHL-Mota Engil companies, at a cost of $202.6 million, and is 20% complete.

    In the 2.2 kilometers that the project comprises, 85 piles will be built for the viaduct and another 10 for the Villa Zaita Station. The terminal station in Villa Zaita will be connected to a bus and taxi interchange that will have 16 parking docks (and the capacity to serve 8,000 passengers during peak hours.

    A total of 2,800 jobs are currently generated by the three projects. Of the three, the largest is line 3, which will connect the Albrook station on line 1 with the City of the Future in Arraiján.

    The work has a cost of 2.844 billion and was awarded to the Korean consortium HPH Joint Venture, made up of the companies Hyundai Engineering & Construction Co., Ltd, and Posco Engineering Construction.

    The projection of the Metro is that the 'heavy' works related to the tunnel will be carried out within the 54-month period that the Korean group has to build the elevated section. This period would not be enough to install the auxiliary and operating systems, as well as to carry out the tests of the complete line, so the construction time contemplated in the original contract would have to be extended.

    During the training, officials from the National Directorate of Electoral Organization explained to the activists the use of the tools available to the TE for the process of collecting signatures, which are: regional offices of the district of Panama, platform Tribunal Contigo www. tribunalcontigo.com, the 40 multiservice kiosks located in different parts of the country or through mobile devices that have the application with facial biometric validation.

    The TE indicated that the activist who uses the application on their cell phones will have the following responsibilities: to make good use of the technological tool for registering the signatures that support the popular initiative, to keep the information obtained from the citizens who support it confidential; to not allow third-parties to use the tool, to not provide the access code to third parties, sign and comply with the agreement adhering to the instructions described in the application manual.

    In addition, the TE warned that there are places where collecting supporting signatures is prohibited. These are public offices, except those of the Electoral Court; hospitals, nursing homes, educational centers, and religious cults, bars, and nightclubs, and in all private property without the prior authorization of its owners, administrators, or occupants.

    Evaluation of Panama justice system begins July 1

    The Administrative Council of the Judicial Career, chaired by Judge Abel Augusto Zamorano, announced on March 22 the start of the process that seeks to guarantee "equal opportunities for all evaluated and due publicity and transparency”.

    The process, which will take a year, is divided into 12 stages that start on July 1 and conclude with the final evaluation, consolidation, and communication of the results, between the months of July and August 2023.

    The regulation establishes an assessment or score for each of these areas and provides that when these personnel are evaluated and do not achieve a score equal to or greater than 70%, this will constitute a temporary impediment to their transfer and promotion. If the person fails to pass the evaluation in the following consecutive period, he will lose status as a servant of the judicial career.

    Points system
    To evaluate the performance of judicial servants, aspects such as productivity (45%), competencies (25%), good judicial or administrative practices (10%), compliance with ethical standards and discipline (10%) the work environment (5%) and the quality of user service (5%)will be valued.

    On March 4, the president  of the Supreme Court, María Eugenia López, presided over the swearing-in ceremony for the officials who will be in charge of assessing the competencies of judicial servants for performance evaluation

    The team will be in charge of the permanent certification of the competencies required for the performance of the different jobs of the institution and, they will guide the processes of selection, training, and substantiation of the certification and recertification procedure of the applicants and members of the Judicial Branch.

    The law that creates the judicial career was approved in 2005, but to date, the Judicial Branch has not achieved its implementation and most of the judges and magistrates are appointed on an interim basis.

    Judicial delay continues to be a challenge for the administration of justice. At the end of 2019, there were 93,592 files in process. In 2020, the figure was 73,000 and in 2021 it reached more than 66,000.

    At least 20 countries have confirmed their attendance at a regional meeting on migration to be held from April 19 to 20 in Panama and that will include the participation of the head of US diplomacy, Antony Blinken.

    "For more than a year we have been working with the United States and other important American partners to find common ground and areas of articulation to address this phenomenon and avoid an unprecedented humanitarian crisis in the region," said Foreign Affairs Minister Erika Mouynes.

    More voices condemn the controversial ruling of the Electoral Court (TE) that would leave Ricardo Martinelli unpunished in the legal cases of New Business and Odebrecht.

    The Citizen Alliance for Justice,  the Panama arm  of Transparency International in a forceful statement, denounced that the magistrates Heriberto Araúz, and Alfredo Juncá, weakened the action of criminal justice allowing the Electoral Court to become "a safe conduct for corruption" reports La Prensa

    The Citizen Alliance, a civil organization with more than 20 years of existence, also rejected "any invocation of the principle of specialty as a pretext to avoid the action of justice", and stated that as it stands, the criminal electoral jurisdiction is a shield "corrupt and unnecessary" for the effective conduct of internal electoral processes of political parties and movements.

    On the contrary, reports La Prensa President Laurentino Nito Cortizo, and Vice President José Gabriel Carrizo, avoided questioning the ruling, and with ambiguous speeches in which they mentioned the words democracy and institutionalism, they avoided the matter.

    In addition to avoiding Martinelli's trial for the New Business and Odebrecht cases, the recent TE ruling has the political effect of putting the former president in the presidential race heading for the 2024 elections.

    The Homicide and Femicide section of the Metropolitan Prosecutor's Office awaits an autopsy report from the Institute of Legal Medicine to clarify the death of a 25-year-old woman who suffered complications after undergoing cosmetic surgery in Colombia.

    The Ministry of Health (Minsa) has reiterated that the sale of electronic cigarettes is prohibited at the national level and, in coordination with the security forces, vigilance is maintained so that this provision is complied with.

    Two officials from the National Institute of Vocational Training for Human Development (Inadeh)  have been fired after a video of them having sex inside an office went viral on social networks on Thursday, January 13.

    Initially, there was speculation about the veracity of the images,  but Inadeh reported that, after an investigation, both officials were immediately dismissed from their positions.

    The woman involved was a department head, and the man was a chauffeur from the institution reports La Critica.

    Hours after the identity of the lovers and the "vidajeno" who filmed them, as well as their positions and their salaries, were revealed.     Some 92% of hospitalized patients with Covid-19 between UCRE and ICU do not have the complete vaccination cycle said  The National Director of Health Services of the Social Security Fund (CSS), Gustavo Santamaría on Friday, January 14.

    Santamaría said that until noon on Thursday, 259 people admitted with the disease were registered in the entity's medical units nationwide.

    Of that number, 203 are in the ward, 43 in the Special Respiratory Care Unit  (UCRE), and 23 in Intensive Care (ICU).

    “We have between 92% and 93% of the patients, of those who are in intensive care and special respiratory care, who do not have a complete vaccination schedule. They are unvaccinated stayed with one or two doses," said Santamaría.

    He added that they also have a low percentage of patients who, having the complete immunization schedule, require hospital services because they have chronic diseases.

    “In the case of the City of Health [Covid Hospital], which is our thermometer, we have seen that there is an increase between 15 and 20 patients per day. That is a lot for what we were driving,” Santamaría explained.

    At the Covid Hospital, until the last report, 49 patients were counted in the ward, 21 in the UCRE, and 11 in the ICU.

    Panama is in the midst of the fourth wave of the new coronavirus and according to the Pan American Health Organization in recent weeks, there has been a sharp increase in cases.

    Cedeño explained that the metropolitan area -the most populous in the country- is the one with the most active infections at the national level with 9,044, until  Thursday’s report.

    He specified that on Monday the number of people with the virus was 7,700 and that three days later it rose to 9,044, which reflects a significant increase of more than a thousand cases.

    “They are letting their guard down. It is the only explanation why we have so many cases because many are vaccinated,” said Cedeño.

    Cedeño announced that the strategy of mobile swab stations, which was reactivated three weeks ago, will continue to support the fixed coronavirus sampling points of Megamall, Rod Carew Stadium, and Emilio Royo Stadium and also, in this way decongest the high demand in health centers.

    On Friday, for the second consecutive day, the temporary stand located in the parking lots of the Explora Science and Art Center in Condado del Rey was enabled.

    Temporary swab posts will be mobilized in the 23 districts of the region and they will be several times in the sectors where more cases are occurring.

    Between 2020 and 2021, the Children's Hospital treated 438 children infected with covid-19, of this group 15% required pediatric intensive care, while unfortunately, 12 died from the disease.

    So far in 2022, 101 children have been treated, 10% have been diagnosed and hospitalized says the director of the Children's Hospital, Paul Gallardo, highlighting that if these numbers are maintained and at the end of the month there are 200 diagnosed and 12% are hospitalized, this would exceed the number of beds assigned to treat the disease.

    He highlighted the importance of vaccinating children, not only to protect them but because they are vehicles of the virus and to create a safety margin when returning to school in person.

    Convention Center-Cruise Port link underway

    Work has begun on a $44 million project that will connect Cinta Costera 3 to the Amador Convention Center and the Cruise Port said the Minister of Public Works, Rafael Sabonge, during an inspection on Friday, January 7. “This is an important program for the tourism sector because it will allow greater access to the Amador Convention Center and to tourists who come on cruise ships,” said Sabonge.  It is expected to be completed in 18 months.

    The official indicated that this project contributes to the economic reactivation of the country as about 200 direct jobs will be generated. Currently, there are 90 people working on the project, 30 of them from the El Chorrillo community.

    The epidemiological week 51 (from December 19 to 25) closed  with 4,141 cases of Covid-19 disease, which represents 1,651 more cases than the previous one (from December 12 to 18), an increase of 66.3%

    Although hospitalizations in the ward and intensive care units increased from 135 in the previous epidemiological week to 165 in the week that closed Sarurday, the positive impact of vaccination is evident, because, for that same date in 2020, there were 2,031 hospitalized.

    The acceleration of Covid-19 cases coincides with the arrival of the Omicron variant. Infectology specialists do not rule out community transmission of the new variant.

    The arrival of the variant of the is a new test that the country must assume in the face of the pandemic, since its detection coincided with the end of the year holidays, and brings with it an increase that will be very marked in the number of new infected during the remainder of December and January.

    Meanwhile, the new cases with the Omicron variant begin to multiply. On December 19, the first case with this lineage was detected in Panama and until December 24 there were already nine and 17 under investigation, by the Genomic and Proteomic Research Department of the Gorgas Memorial Institute for Health Studies (Icges).

    Those infected with the new variant live in the Health regions of Coclé, San Miguelito and Panama Metro. The cases are from the townships of Río Hato in Coclé; Amelia Denis De Icaza and Rufina Alfaro, in San Miguelito, and Ancón, Betania, Don Bosco and San Francisco in the capital city.

    Over 100 covid vaccination centers reopen Monday

    The Ministry of Health (Minsa) reported  Sunday, December 26, that there are at least 105 anticovid vaccination centers throughout the national territory.

    Immunization points have been installed in health centers, regional hospitals, and shopping centers.

    They will resume operations Monday, December 27. Thousands visited vaccination centers for booster shots following the announcement that the waiting time after the second vaccination had been cut to three months.

    Minsa has reiterated the call to the population to be vaccinated to reduce the risk of complications and death from the coronavirus. It is also important to continue to comply with biosafety measures, such as the use of the mask-face shield combination and constant hand washing.
