Panama’ s  former Director of Revenue, Luis Cucalón, lost his final appeal in the Second Superior Court against his   8-year jail sentence for embezzlement and corruption, in the Cobranzas del Istmo SA case involving fraudulent tax collecting.

Cucalón, who remains in custody, has already served four years in preventive detention  2 years of which were in the comforts of Panama’s most expensive hospital So he has half of the sentence to be served.

The sentence of 8 years was pronounced in the first instance by the First Criminal Court on September 14, 2018. Subsequently, the sentence was confirmed by the Second Court on January 31, 2019.

Embezzler’s bid to leave jail cell for house arrest denied

Compliance judge, James Corro, denied on Tuesday, February 11, a request for house arrest filed by the defense of the former Director-General of Revenue, Luis Cucalón currently serving an eight-year prison term for embezzlement and corruption of public servants.

Before  being sentenced  Cucalón gained additional notoriety as he  avoided justice by remaining in one of  Panama’s most expensive private hospitals

Defense attorney Calderón told the judge that Cucalón suffers from chronic diseases and that he does not receive the necessary treatment at the El Renacer prison.

According to the Judicial Branch, the petition was denied because the defense did not submit an updated legal medical report and  also did not present a domiciliary offer

The judge ordered  Cucalón to  have a new legal medical evaluation by the staff of the Institute of Legal Medicine and Forensic Sciences and gave the defense 20 days to present the report adding: “With this report, I will  determine if you can remain in prison or not..”

Luis Cucalón, the former director of the General Directorate of Income  (DGI)who skulked in a private hospital for two years before being forced to attend trial where he was sentenced to eight years in jail for embezzlement has been granted a move to house arrest by a compliance judge.

Prosecutor Zuleyka Moore, who was representing the Public Ministry, disagreed with the decision made by Judge Sánchez, considering that the accused should finish serving time in prison.

This means that it will be up to the Superior Court of Appeals to determine whether to endorse the decision made by Judge Sánchez or to revoke it.

Cucalón is serving a sentence of 96 months in prison at the El Renacer Penitentiary Center, after the First Criminal Court on September 14, 2018 sentenced him for the crimes of corruption of a public official and embezzlement.

During his tenure with the DGI, Cucalón authorized the company Cobranzas del Istmo to collect irregular taxes, through whose management an injury to the State was caused.

COVID-19 gets  embezzler moved from jail to home

The Superior Court of Appeals of has confirmed a move to houses arrest for a term of three months in favor of former director-general of revenue Luis Cucalón, who is serving a sentence of 96 months for embezzlement and corruption of a public official.

At a hearing held on Monday, May 11, the Court of Appeals deemed it prudent to grant Cucalón the house arrest measure, after determining that he suffers from an obstructive pulmonary disease that requires specialized medical treatment.

Among the considerations of the judges ruled  the measure is consistent with the recommendations made by human rights organizations, that, due to the Covid-19 pandemic, it is recommended that those deprived of liberty with chronic diseases be benefited by measures of house arrest

Ángel Calderón, a lawyer from Cucalón, said that the measure was accepted by the magistrates of the court when it was verified that the health of his client is compromised by multiple ailments that warrant daily monitoring by doctors.

Senior anti-corruption prosecutor Zuleyka Moore opposed the request made by the defense of Cucalón, arguing that there was no certification from the Institute of Legal Medicine and Forensic Sciences about his state of health.

Cucalón was sentenced on September 14, 2018.

He had dodged trial for two years by staying in Panama’s most expensive hospital. Details of his alleged illness were not revealed.

Luis Cucalón,  the former head of the General Directorate of Revenue (DGI),  who spent two years avoiding trial for corruption by remaining in a high-end hospital  will finish his 86 month jail term under house arrest

His lawyer Ángel Calderón said that, after 72 months of detention in the case of Cobranzas del Istmo, Cucalón applied for a different classification for which a Compliance Judge agreed, later an appeal was filed by the Public Ministry (MP), which went to the Superior Oral Court.

That court, Calderón explains, agreed with the first instance and ordered the  transfer of  Cucalón to his residence so that he could be in " better conditions ."

According to his lawyer, Cucalón has  multiple chronic medical symptoms, the most serious being a grade 3 chronic lung disease, and if his client contracted  covid-19 while in detention, "it would be a death sentence ."

The process to achieve the change of detention began in November 2019.

A compliance judge ordered, on Tuesday, June 29, that experts from the Institute of Legal Medicine and Forensic Sciences (Imelcf) carry out a medical-legal clarification to determine if the former director of the General Directorate of Revenue (DGI), Luis Cucalón , can serve his sentence in a penitentiary.

The decision of the compliance judge Roberto Sánchez was taken this Tuesday during a control and verification hearing followed by Cucalón, who was punished for the crime against the public administration, in the form of embezzlement and corruption of public servants, to the detriment of the Ministry of Economy and Finance.

Cucalón gained additional notoriety  when avoided numerous trial dates by hiding for two years behind the walls of the Punta Pacific Hospital, the present home of Ricardo Martinelli

Sánchez set for next Wednesday, August 4, at 10:00 am, a new control and verification hearing, in order to have the information requested from the Imelcf experts.

During the hearing, the Public Ministry was represented by the Anticorruption prosecutor, Anilú Batista Carles, while the private defense was in charge of Ángel Calderón.

On September 14, 2018, Cucalón was declared criminally responsible and sentenced by the First Criminal Circuit Court of Panama to 96 months in prison. While, on May 7, 2020, Sánchez granted the domiciliary deposit measure in favor of Cucalón.

Judge extends house arrest for jailed embezzler

The compliance judge Roberto Sánchez granted an extension until December 30 of the house arrest measure in favor of the former director of the General Directorate of Revenue (DGI) Luis Cucalón.

Cucalón avoided arrest for two years in the Punta Pacifica Hospital before being sentenced to eight years in prison for embezzlement and corruption of public servants to the detriment of the Ministry of Economy and Finance.

Sánchez made the decision based on a  medical report from the Institute of Legal Medicine and Forensic Sciences which said that the ailments that the sanctioned person presents make him vulnerable to Covid-19, so it is risky to send him to prison.

The judge also took into consideration recommendations of the Ministry of Health regarding chronic diseases that can put a patient at risk from the coronavirus.

In May 2020, a compliance judge granted the measure of house-arrest to Cucalón after it was found that he had multiple ailments, which required specialized treatment.

Probation revoked for former DGI director

The compliance judge, Roberto Sánchez, revoked the probation measure granted to the former Director of General Revenue (DGI), Luis Cucalón, who is serving a 96-month prison sentence for embezzlement crimes, corruption of public servants to the detriment of the Ministry of Economy and Finance (MEF).

The judge's decision was given after a request from the compliance section of the Anti-Corruption Prosecutor's Office, after considering that Cucalón can serve the rest of his sentence in prison.

Cucalón has maintained a probation measure since last January, which had been granted by a compliance judge, but the prosecution requested its revocation after the defendant could not establish an address where he could be monitored by the authorities.

Next September Cucalón must face a hearing for money laundering.

Through mixed order No. 02 dated March 14, 2023, the first liquidating judge, Agueda Rentería, ordered Cucalón, Cristóbal Salerno, and two others accused for the crime of money laundering, having as an offense precedent that of embezzlement and corruption, for which Cucalón was sentenced to 96 months in prison.

The Superior Court of Appeals confirmed that the former director of the General Directorate of Income (DGI), must return to prison for violating the probation measure that was granted to him by a compliance judge.

During a hearing held on Tuesday, May 16, magistrates Adilio González, Luis Mario Carrasco, and María Vigil decided to accept the request of the Anti-Corruption Prosecutor's Office to revoke the measure of supervised detention and apply preventive detention.

The anti-corruption prosecutor, Anilu Batista, explained that it was found that Cucalón did not appear regularly at his workplace, which is why she asked to revoke his probation benefit.

On May 9, 2023, the compliance judge, Roberto Sánchez, of the Accusatory Criminal System of the First Judicial District revoked the probation measure granted to Cucalón, who is serving a 96-month prison sentence for the crimes of embezzlement, and corruption of public servants.

In September Cucalón must face a hearing for the alleged commission of the crime of money laundering.

Luis Cucalón, the former head of the General Directorate of Income (DGI), returned to prison after the Judicial Investigation Directorate (DIJ) of the National Police captured him on Tuesday, June 13.

Cucalón's capture occurred after the Superior Court of Appeals, during a hearing held on May 16, confirmed an opinion by compliance judge Roberto Sánchez, who revoked the probation measure that had been granted.

At that hearing, the anti-corruption prosecutor, Anilu Batista, explained that it was found that Cucalón did not appear regularly at his workplace, which is why he was asked to revoke his benefit and re-admit him to prison.

Cucalón was sentenced to 96 months in prison for embezzlement, corruption of public servants to the detriment of the Ministry of Economy and Finance (MEF).

The prosecutor's office also requested Cucalón's return to prison, because the convicted person could not provide an address where he could be monitored by the authorities.

Luis Cucalon,the former head of the General Directorate of Income (DGI),  will be under house arrest and must wear an electronic bracelet ordered by the compliance judge of the first judicial circuit of Panama, Roberto Sánchez, who agreed to a  request by the defense of the former Panamanian official.

Cucalón was sentenced to 96 months in prison for embezzlement and corruption of public servants to the detriment of the Ministry of Economy and Finance (MEF).

In making the decision, Judge Robert Sánchez took into account that Cucalón is 70 years old and suffers from several chronic diseases certified by the Institute of Legal Medicine and Forensic Sciences, the Judicial Branch reported.

Cucalón had returned to prison after the Judicial Investigation Directorate (DIJ) of the National Police executed his capture. This action occurred after the Superior Court of Appeals −during a hearing held on May 16− confirmed an opinion by Judge Sánchez, who revoked the probation measure that had been granted.

The First Criminal Circuit Court of Panama ordered the sentence of imprisonment for Cucalón, on September 14, 2018.
